{"id":6122,"date":"2021-06-03T11:20:35","date_gmt":"2021-06-03T17:20:35","guid":{"rendered":"https:\/\/borderlessmag.org\/?p=6122"},"modified":"2025-10-09T11:10:37","modified_gmt":"2025-10-09T16:10:37","slug":"los-defensores-publicos-del-condado-de-cook-pueden-representar-a-los-inmigrantes-que-se-enfrentan-a-la-deportacion-en-los-tribunales-de-inmigracion-en-virtud-de-un-nuevo-proyecto-de-ley-estatal","status":"publish","type":"post","link":"https:\/\/borderlessmag.org\/es\/2021\/06\/03\/cook-county-public-defenders-can-represent-immigrants-facing-deportation-in-immigration-court-under-new-state-bill\/","title":{"rendered":"Los defensores p\u00fablicos del condado de Cook pueden representar a los inmigrantes que se enfrentan a la deportaci\u00f3n en el Tribunal de Inmigraci\u00f3n en virtud de un nuevo proyecto de ley estatal"},"content":{"rendered":"<p><em>Never miss a story. <a href=\"https:\/\/borderlessmag.org\/newsletter\">Sign up for our Thursday newsletter<\/a>\u00a0to learn the latest about Chicago\u2019s immigrant communities.<\/em><\/p>\n<p>A bill passed Monday by the Illinois General Assembly would allow the Cook County public defender\u2019s office to represent immigrants at the Chicago Immigration Court, a step that advocates said will help more immigrants in the county avoid deportation.<\/p>\n<p>Unlike criminal defendants, immigrants facing deportation don\u2019t have the right to a government-appointed attorney.\u00a0<a href=\"https:\/\/www.injusticewatch.org\/news\/immigration\/2021\/cook-county-conviction-deportation-pipeline\/\" target=\"_blank\" rel=\"noopener\">The Cook County public defender\u2019s office created an immigration unit last year to represent immigrants in immigration court<\/a>, but it needed authorization from the state legislature to do so.<\/p>\n<p>The bill,\u00a0<a href=\"https:\/\/ilga.gov\/legislation\/fulltext.asp?DocName=&amp;SessionId=110&amp;GA=102&amp;DocTypeId=HB&amp;DocNum=2790&amp;GAID=16&amp;LegID=131644&amp;SpecSess=&amp;Session=\" target=\"_blank\" rel=\"noopener\">HB 2790<\/a>, passed the state Senate 36 to 18, along party lines, after passing the House last month. The bill now heads to Democratic Gov. J.B. Pritzker\u2019s desk. Immigrants are five to 10 times more likely to avoid deportation if they have legal representation, according to recent studies that analyzed immigration court data from\u00a0<a href=\"https:\/\/immigrantjustice.org\/lpfreport2020\" target=\"_blank\" rel=\"noopener\">Chicago<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.vera.org\/downloads\/publications\/a-federal-defender-service-for-immigrants.pdf\" target=\"_blank\" rel=\"noopener\">New York<\/a>.<\/p>\n<p>The bill doesn\u2019t require Cook County to provide a lawyer for every immigrant facing deportation or provide the county with new state funds to hire more immigration attorneys. Indeed, the county\u2019s immigration unit has enough funding to hire just two immigration attorneys this year. Advocates want the county to hire another two next year \u2014 which is not nearly enough to represent everyone in need of a lawyer at the Chicago Immigration Court.<\/p>\n<p>But local immigrant rights advocates with the Defenders for All Coalition, which helped push for the bill, said it is a small step toward their ultimate goal of legal representation for everyone in immigration court.<\/p>\n<p>\u201cEveryone has the right to due process, including immigrants, and immigrants should also have the right to an attorney if they can\u2019t afford one,\u201d said Er\u00e9ndira Rend\u00f3n, vice president of immigrant advocacy and defense at The Resurrection Project, a nonprofit based in Chicago\u2019s Pilsen neighborhood and one of the coalition\u2019s lead organizers. \u201cThe coalition will keep working towards universal representation, and this bill is one important piece that helps us get there.\u201d<\/p>\n<p>Hena Mansori, a longtime Chicago immigration attorney who was tapped to lead the public defender\u2019s immigration unit, said she expects the unit to take on its first deportation case early next year.<\/p>\n<p>The immediate focus will be to represent immigrants in immigration detention and to take on cases stemming from criminal convictions that could set legal precedents that would benefit other immigrants in similar circumstances, Mansori said.<\/p>\n<h4 id=\"the-benefits-of-pds-in-immigration-court\"><strong>The benefits of PDs in immigration court<\/strong><\/h4>\n<p>More than 40 cities and counties provide public funds for deportation defense. Most of those jurisdictions \u2014 including Chicago \u2014 pay immigration nonprofits to take on deportation cases.<\/p>\n<p>Only a handful have public defenders directly represent immigrants in immigration court. One of the first was Alameda County, California, which includes Oakland and Berkeley and was one of the models for Cook County\u2019s immigration unit.<\/p>\n<p>Raha Jorjani, who has run the\u00a0<a href=\"https:\/\/www.acgov.org\/defender\/services\/immigration.htm\" target=\"_blank\" rel=\"noopener\">Alameda County immigration unit<\/a>\u00a0since its inception in 2014, said incorporating deportation defense within a public defender\u2019s office helps cut down the time that an immigrant might spend in detention \u2014 which helps keeps immigrant families and their communities intact.<\/p>\n<p>\u201cWhen you\u2019re able to start the defense early, even before someone ends up in immigration custody, ultimately, you are reducing the amount of time that [a client] might have to be in custody,\u201d Jorjani said.<\/p>\n<p>Irakere Pic\u00f3n, a lead organizer of the Defenders for All Coalition and director of legal services at the Illinois Business Immigration Coalition, said nonprofits can only \u201cfill in the voids\u201d that exist in funding from city, county, and state governments.<\/p>\n<p>Publicly funded immigration defense programs are a \u201cmuch more permanent\u201d solution, Pic\u00f3n said.<\/p>\n<p>The continuity of service and commitment to defending immigrants, even if their cases are complicated by an arrest or a criminal conviction, are hallmarks of the public defender model, said Kenney, who is the associate program director of the\u00a0<a href=\"https:\/\/www.vera.org\/initiatives\/safe-initiative\" target=\"_blank\" rel=\"noopener\">Safety and Fairness for Everyone Initiative<\/a>\u00a0at the Vera Institute of Justice, which partners with local jurisdictions on deportation defense programs and advocates for universal representation.<\/p>\n<p>Embedding a deportation defense program in a public defender\u2019s office shows a county\u2019s \u201cfirm commitment that everyone, regardless of their contact with the criminal legal system, regardless of their national origin, deserves a zealous defense when they\u2019re faced with the consequences of deportation,\u201d Kenney said.<\/p>\n<p>Since she started in September, Mansori has focused on\u00a0<a href=\"https:\/\/www.injusticewatch.org\/news\/immigration\/2021\/immigration-lawyers-tips-for-noncitizens-in-criminal-court\/\" target=\"_blank\" rel=\"noopener\">advising public defenders about how to mount the best criminal defense for their noncitizen clients<\/a>. Once the bill is signed into law, she said the unit will be able to keep representing some of those same clients if they end up in deportation hearings.<\/p>\n<p>The Cook County Board of Commissioners allocated $350,000 for the immigration unit for this fiscal year, which ends Nov. 30. The JB and MK Pritzker Family Foundation, a philanthropic organization funded by Pritzker\u2019s personal fortune, chipped in another $300,000 to help launch the unit. It hopes to have two attorneys, a paralegal, and a case manager by the end of the year.
