The bill now goes to Gov. J.B. Pritzker\u2019s desk for his signature.<\/p>\n<p>Under the bill \u2014\u00a0known as the\u00a0<a href=\"https:\/\/www.ilga.gov\/legislation\/BillStatus.asp?DocNum=0667&amp;GAID=16&amp;DocTypeID=SB&amp;LegID=133273&amp;SessionID=110&amp;SpecSess=0&amp;Session=&amp;GA=102\">Illinois Way Forward Act<\/a>\u00a0\u2014\u00a0cities and counties in Illinois would be prohibited from entering into contracts with U.S. Immigration and Customs Enforcement to \u201chouse or detain\u201d immigrants in ICE custody at local jails. The state already\u00a0<a href=\"https:\/\/psmag.com\/news\/illinois-is-cracking-down-on-private-immigration-detention\">restricts private immigration detention centers<\/a>, so if Gov. Pritzker signs it into law, it would rid Illinois of all existing ICE detention centers by Jan 1, 2022.<\/p>\n<p>A spokesperson for Pritzker\u2019s office did not respond to a request for comment Friday. And an ICE spokesperson said the agency \u201cdoes not comment on specific proposed legislation.\u201d<\/p>\n<p>The bill would limit how police across the state cooperate with the immigration enforcement agency. Local law enforcement agencies would be prohibited from asking anyone in their custody about their immigration status. Omar Aquino, D-Chicago, who represents parts of Chicago\u2019s Northwest Side and western suburbs,\u00a0<a href=\"https:\/\/www.ilga.gov\/legislation\/BillStatus.asp?DocNum=667&amp;GAID=16&amp;DocTypeID=SB&amp;SessionID=110&amp;GA=102\">introduced the bill in February<\/a>. Since then, half of the other 40 senate Democrats have co-sponsored the bill, including Senate Majority Leader Kimberly Lightford, D-Maywood.<\/p>\n<p>The bill passed the Senate 36 to 19 Friday, with all Republicans and one Democrat voting no. Senate Minority Leader Dan McConchie, R-Lake Zurich, did not respond to a request for comment about his opposition to the bill. It passed the House late Monday, 68 to 47.<\/p>\n<p>The Illinois Fraternal Order of Police opposed the bill. The organization\u2019s president, Chris Southland, said local law enforcement should aid federal authorities in apprehending immigrants with criminal records.<\/p>\n<p>\u201cWhy would we not want to work with the federal authorities to make sure violent, illegal immigrants are not released [from local law enforcement custody] within our communities?\u201d Southwood said.<\/p>\n<p>An analysis by the Transactional Records Access Clearinghouse at Syracuse University showed that four<a class=\"c-link\" href=\"https:\/\/trac.syr.edu\/immigration\/reports\/601\/#:~:text=Most%20Detained%20Immigrants%20Have%20No,been%20convicted%20of%20a%20crime.&amp;text=Starting%20from%20a%20low%20of,before%20falling%20currently%20to%2038%2C058.\" target=\"_blank\" rel=\"noopener noreferrer\" data-stringify-link=\"https:\/\/trac.syr.edu\/immigration\/reports\/601\/#:~:text=Most%20Detained%20Immigrants%20Have%20No,been%20convicted%20of%20a%20crime.&amp;text=Starting%20from%20a%20low%20of,before%20falling%20currently%20to%2038%2C058.\" data-sk=\"tooltip_parent\">\u00a0in ten immigrants detained in ICE custody last year had any criminal convictions<\/a>\u00a0on their records. An even smaller share \u2014 just under 11% \u2014 had been convicted of what ICE considers serious (or \u201cLevel 1\u201d) offenses like assault, sexual crimes, or murder.<\/p>\n<p>If the bill becomes law, Illinois would join a small group of states \u2014 including California and Washington \u2014 that enforce statewide sanctuary laws and prohibit counties from contracting with ICE to operate detention centers. ICE could still directly operate its own detention centers, but the agency does not currently have any facilities in Illinois.<\/p>\n<p>Tsao said the bill \u201ccould be a model for other states that want to extend further protections to their immigrant communities.\u201d<\/p>\n<p>Tsao said the Illinois Way Forward Act takes its name from the New Way Forward Act, which Rep. Jesus \u201cChuy\u201d Garcia, a Chicago Democrat,\u00a0<a href=\"https:\/\/www.injusticewatch.org\/news\/immigration\/2021\/prison-deportation-pipeline-chuy-garcia-new-way-forward-act\/\">introduced in the U.S. House of Representatives in January<\/a>. Garcia\u2019s bill, which has stalled in committee, would phase out the use of private detention centers and county jails to hold immigrants in federal custody and restrict cooperation between local law enforcement and ICE, among other provisions.<\/p>\n<p><b>\u2018I don\u2019t think counties should be profiting off of people\u2019s misery\u2019<\/b><\/p>\n<div id=\"attachment_6116\" style=\"width: 1034px\" class=\"wp-caption alignnone\"><img decoding=\"async\" aria-describedby=\"caption-attachment-6116\" class=\"wp-image-6116 size-large\" src=\"https:\/\/borderlessmag.org\/wordpress\/wp-content\/uploads\/2021\/12\/ELIZARRARAZ_FAMILY-web-1024x768.jpg\" alt=\"detention, center, immigrant, immigration, bill, Illinois, house, Pritzker, courts, jail, pipeline, McHenry, ICE\" width=\"1024\" height=\"768\" \/><p id=\"caption-attachment-6116\" class=\"wp-caption-text\">Kristin Glauner (second from the left in the top row), poses with her brother-in-law, Arturo Elizarraraz, and her five children and after the McHenry County Board of Commissioners voted May 18 to uphold the county\u2019s contract with ICE to detain immigrants at the county jail. Carlos Ballesteros \/ Injustice Watch<\/p><\/div>\n<p>An ICE spokesperson said the agency currently has contracts with three Illinois counties \u2014 Kankakee, McHenry, and Pulaski \u2014 to detain immigrants at their county jails. ICE pays Kankakee County $90 a day per detainee and McHenry County $95 per detainee, according to officials in both counties. Officials in Pulaski County did not respond to requests for comment.<\/p>\n<p>Tsao said closing detention centers would put an end to \u201cprofit motives for counties and private companies to just make money off of locking people away.\u201d It would also send a message to the federal government that holding immigrants in jails for alleged immigration infractions is wrong, he said.<\/p>\n<p>But closing the detention centers doesn\u2019t mean that immigrants detained there would be released. ICE could transfer them to one of\u00a0<a href=\"https:\/\/www.ice.gov\/detention-facilities?state=All&amp;office=&amp;name=&amp;page=0\">more than 100 other detention centers it operates or contracts nationwide<\/a>, an ICE official said.<\/p>\n<p>On May 18, the McHenry County board of commissioners\u00a0<a href=\"https:\/\/chicago.suntimes.com\/2021\/5\/18\/22442311\/chicago-immigration-ice-mchenry-county-board\">voted down a proposal to cancel its ICE contract<\/a>, following a year-long campaign from dozens of activist groups. Some board members argued at the meeting that the country shouldn\u2019t forgo that revenue since ICE will detain immigrants anyway. The contract netted the county more than $3 million per fiscal year from 2016 to 2020, according to a report from the county board.<\/p>\n<p>But Amanda Hall, an educator and co-founder of the Coalition to Cancel the ICE Contract in McHenry County, said the ICE contract with the county jail \u201cterrorizes\u201d immigrants in the area because they\u2019re \u201cscared of police officers and being pulled over\u201d and then put in ICE custody.<\/p>\n<p>Those fears materialized for Kristin Glauner, 39, a mother of five who lives in McHenry County. Her husband, Cesar Elizarraraz, has been in immigration detention at the county jail for nearly two years, after local police arrested him for allegedly selling a used car without a permit, she said. Elizarraraz did not have proper documentation to live in the U.S., and Glauner suspects the Crystal Lake Police Department handed him over to ICE. The police department did not respond to emails or calls for comment.<\/p>\n<p>Under the Illinois Way Forward Act, the Crystal Lake police would\u2019ve been barred from asking about Elizarraraz\u2019s immigration status, transferring him to ICE, or informing the agency that he was in their custody.<\/p>\n<p>Glauner wants the McHenry County detention center to close, even if it means that her husband would get transferred out of the state.<\/p>\n<p>\u201cI don\u2019t think counties should be profiting off of people\u2019s misery,\u201d she said.<\/p>\n<h4 id=\"our-work-is-made-possible-thanks-to-donations-from-people-like-you-support-high-quality-reporting-by-making-a-tax-deductible-donation-today\" class=\"pk-content-block pk-block-bg pk-block-bg-light\" style=\"text-align: left;\"><span style=\"color: #993300;\">Our work is made possible thanks to donations from people like you.
