And that could count as grounds for a denial.<\/p>\n<p>The change comes as immigrant families face mounting fear, anxiety and strain from continued immigration enforcement and benefits cuts from the Trump administration. Immigrants and families with mixed immigration statuses are worried and reconsidering participating in programs they would qualify for, immigrant rights advocates say.<\/p>\n<\/div>\n\n\n\n\n\t\t<div id=\"fws_6ad9098899372\"  data-column-margin=\"default\" data-midnight=\"dark\"  class=\"wpb_row vc_row-fluid vc_row vc_row-o-equal-height vc_row-flex vc_row-o-content-middle large top_margin_20px bottom_margin_20px\"  style=\"padding-top: 0px; \" class=\"vc_col-sm-5 wpb_column column_container vc_column_container col child_column neg-marg no-extra-padding inherit_tablet inherit_phone \"   data-padding-pos=\"all\" data-has-bg-color=\"false\" data-bg-color=\"\" data-bg-opacity=\"1\" data-animation=\"\" data-delay=\"0\" >\n\t\t<div class=\"vc_column-inner\" >\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t\n\t<div class=\"wpb_raw_code wpb_raw_html wpb_content_element\" >\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<div class=\"_form_1\"><\/div><script src=\"https:\/\/borderlessmag.bluelena.io\/f\/embed.php?id=1\" charset=\"utf-8\"><\/script>\n\t\t<\/div>\n\t<\/div>\n\n\t\t<\/div> \n\t<\/div>\n\t<\/div> \n<\/div><\/div>\n\t\t\t<\/div> \n\t\t<\/div>\n\t<\/div> \n<\/div><\/div>\n\n<div class=\"wpb_text_column wpb_content_element \" >\n\t<p>\u201cIf a U.S. citizen child uses the CHIP [Children&#8217;s Health Insurance Program] program or Head Start that may now be an indication that a green card applicant is of low-income, and therefore it can then trigger a public charge of determination,\u201d said Adriana Cadena, executive director of the national <a href=\"https:\/\/pifcoalition.org\/\">Protecting Immigrant Families Coalition<\/a>, where more than 800 groups are working to expand families\u2019 access to housing, work, education and other resources.<\/p>\n<p>That means families are having to choose between applying for a green card or meeting their basic needs, advocates and healthcare providers say.<\/p>\n<p>Some patients at <a href=\"https:\/\/www.esperanzachicago.org\/\">Esperanza Health Centers<\/a> in Chicago have had to make tough calls, said Mar\u00eda M\u00e1rquez, who leads the federally qualified health center on the city\u2019s southwest side.<\/p>\n<p>\u201cWe have a pregnant patient who delayed care until the third trimester because of fear of what public charge can do to (their) status or (their) partner,\u201d said M\u00e1rquez, who joined Cadena and the <a href=\"https:\/\/www.icirr.org\/\">Illinois Coalition for Immigrant and Refugee Rights<\/a> online in late September to speak on the federal rule. \u201cWe have patients who qualify for benefits forgoing benefits because of fear of impact due to public charge rules \u2013 and these things are only getting worse.\u201d<\/p>\n<p>Borderless Magazine breaks down what this means, who is impacted and what immigrants can do now that this rule change is in effect.<\/p>\n<h3 id=\"what-is-public-charge\"><b>What is \u2018public charge\u2019?\u00a0<\/b><\/h3>\n<p>The public charge rule is not new.<\/p>\n<p>Immigration officers use it to decide whether the applicant seeking legal permanent residency would be deemed likely to depend on the government for assistance, the U.S. Customs and Immigration Services (USCIS) said. Officers also consider an applicant\u2019s age, health, family, finances, education and affidavit of support among other things.<\/p>\n<p>In 2022, the Biden administration narrowed the rule to those using cash assistance programs such as Temporary Assistance for Needy Families (TANF). It also considered those who may need federal aid for long-term institutionalized care from nursing homes or mental health facilities.<\/p>\n<\/div>\n\n\n\n\n\t\t\t<\/div> \n\t\t<\/div>\n\t<\/div> \n\n\t<div  class=\"vc_col-sm-2 vc_hidden-sm vc_hidden-xs wpb_column column_container vc_column_container col no-extra-padding inherit_tablet inherit_phone flex_gap_desktop_10px \" Department of Homeland Security has since rescinded that rule, which now allows officers to consider \u201cin totality\u201d an applicants\u2019 use of \u201cany and all benefits\u201d and \u201cmake case-by-case decisions,\u201d USCIS said.<\/p>\n<p>That means immigration officers could have more discretion, Cadena said.<\/p>\n<h3 id=\"which-green-card-applicants-are-affected-by-the-rule-change\"><strong>Which green card applicants are affected by the rule change?\u00a0<\/strong><\/h3>\n<p>Not all immigrants applying for green cards are impacted by the rule change, Cadena said.<\/p>\n<p>Public charge applies to immigrants applying for green cards through family-based petitions or people with green cards who leave the country for more than six months.<\/p>\n<p>That includes:<\/p>\n<ul>\n<li aria-level=\"1\">spouses, children, siblings and parents of U.S. citizens,<\/li>\n<li aria-level=\"1\">fiances or widows of U.S. citizens,<\/li>\n<li aria-level=\"1\">spouses, children and unmarried sons and daughters of legal permanent residents,<\/li>\n<li aria-level=\"1\">religious workers,<\/li>\n<li aria-level=\"1\">skilled and priority workers<\/li>\n<li aria-level=\"1\">and professionals with advanced degrees.<\/li>\n<\/ul>\n<p>The full list is available on the <a href=\"https:\/\/www.uscis.gov\/newsroom\/alerts\/uscis-issues-guidance-on-making-public-charge-inadmissibility-determination\">USCIS website<\/a>.<\/p>\n<h3 id=\"which-applicants-are-exempt\"><strong>Which applicants are exempt?<\/strong><\/h3>\n<p>There are many people exempt from the public charge rule, said Cadena and Emma Melton, managing attorney at <a href=\"https:\/\/resurrectionproject.org\/\">The Resurrection Project<\/a>.<\/p>\n<p>Asylees, refugees and survivors of human trafficking applying for a T nonimmigrant status are among the many, according to <a href=\"https:\/\/www.uscis.gov\/newsroom\/alerts\/uscis-issues-guidance-on-making-public-charge-inadmissibility-determination\">USCIS<\/a>. Those with Special Immigrant Juvenile Status and who filed petitions under the Violence Against Women Act are also listed.<\/p>\n<h3 id=\"what-benefits-are-considered-in-public-charge\"><strong>What benefits are considered in public charge?<\/strong><\/h3>\n<p>Programs funded by the government or based on income are more likely to be considered in a public charge test. \u201cMeans-tested\u201d benefits such as SNAP, TANF, the Special Supplemental Nutrition Program for Women, Infants and Children (WIC) or the Housing Choice Voucher Program provide aid to people earning incomes that fall below a certain amount.<\/p>\n<p>\u201cThat\u2019s why college tuition assistance can be used,\u201d Melton told Borderless. \u201cFAFSA [The Free Application for Federal Student Aid] requires you to give your financial history. It\u2019s used as a deciding factor in whether they should give you that tuition assistance.\u201d<\/p>\n<h3 id=\"what-benefits-are-excluded\">What benefits are excluded?<\/h3>\n<p>That list is much smaller, Melton said. Social Security benefits, including disability insurance, are excluded.<\/p>\n<h3 id=\"what-is-a-public-charge-bond\"><strong>What is a public charge bond?<\/strong><\/h3>\n<p>USCIS may ask applicants to post a public charge bond before approving their adjustment of status. The bond \u2013 a cash bond or surety bond \u2013 is a \u201cfinancial guarantee\u201d that assures the person will not depend on certain government benefits in the future, USCIS said.<\/p>\n<p>The bond\u2019s amount is based on how much the applicant may receive in government assistance over the next five years.<\/p>\n<h3 id=\"what-should-i-do\"><b>What should I do?<\/b><\/h3>\n<p>Stay informed, said Edith Avila Hesser, health justice and policy director at ICIRR.<\/p>\n<p>Individuals can also call the coalition\u2019s hotline at 1-855-435-7693 for guidance on the new public charge rule. For additional support, Hesser and Melton say, contact community groups on the rule change or consulting with immigration attorneys.<\/p>\n<p>\u201cBefore starting or stopping any benefits purely out of fear of immigration consequences, folks should talk to attorneys that specialize in immigration law just to make sure they\u2019re not missing anything,\u201d Melton said.<\/p>\n<p>Borderless Magazine has compiled a list of <a href=\"https:\/\/borderlessmag.org\/2026\/04\/09\/where-can-i-find-free-immigration-lawyers-in-chicago\/\">free immigration lawyers in Chicago<\/a>. There are <a href=\"https:\/\/www.justice.gov\/eoir\/file\/probonofulllist\/dl\">two pro bono legal service providers<\/a> in Illinois, according to the Department of Justice.<\/p>\n<p>\u201cTo directly impacted individuals, we remind them to stay calm and verify the facts,\u201d Hesser said on the call. \u201cThe public charge rule does not impact all immigrants.\u201d<\/p>\n<p><i>F.
