Immigration law experts, however, warn that this could impact hundreds of thousands of Green Card applicants each year.<\/p>\n<p dir=\"ltr\">\u201cThis is a rewrite of what has been practiced for the last several years,\u201d said Sharvari Dalal-Dheini, senior director for government relations at the American Immigration Lawyers Association (AILA), during an AILA press briefing last week.<\/p>\n<p dir=\"ltr\">Borderless Magazine put together a guide about what Green Card applicants need to know about the policy and its impact.<\/p>\n<h1 id=\"what-is-a-green-card-and-who-can-apply\" dir=\"ltr\">What is a Green Card, and who can apply?<\/h1>\n<p dir=\"ltr\">A Green Card, also known as a Permanent Resident Card, allows the holder to live, travel and work in the U.S. indefinitely. It is widely known as a pathway to U.S. citizenship through naturalization.<\/p>\n<p dir=\"ltr\"><a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-processes-and-procedures\/adjustment-of-status\">Adjustment of status<\/a> is a process established in 1952 that allows eligible individuals to apply for a Green Card when present in the United States, without needing to leave the country and apply through a consulate abroad.<\/p>\n<p dir=\"ltr\">A Green Card applicant <a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-eligibility-categories\">must be eligible<\/a> under one of these categories:<\/p>\n<ul>\n<li dir=\"ltr\" aria-level=\"1\">\n<p dir=\"ltr\" role=\"presentation\">Family sponsorship,<\/p>\n<\/li>\n<li dir=\"ltr\" aria-level=\"1\">\n<p dir=\"ltr\" role=\"presentation\">Employment,<\/p>\n<\/li>\n<li dir=\"ltr\" aria-level=\"1\">\n<p dir=\"ltr\" role=\"presentation\">Special immigrant status,<\/p>\n<\/li>\n<li dir=\"ltr\" aria-level=\"1\">\n<p dir=\"ltr\" role=\"presentation\">Refugee or asylee status<\/p>\n<\/li>\n<li dir=\"ltr\" aria-level=\"1\">\n<p dir=\"ltr\" role=\"presentation\">Victims of human trafficking or crime<\/p>\n<\/li>\n<li dir=\"ltr\" aria-level=\"1\">\n<p dir=\"ltr\" role=\"presentation\">Or for victims of abuse.<\/p>\n<\/li>\n<\/ul>\n<h1 id=\"what-is-the-current-process-to-apply-for-a-green-card\" dir=\"ltr\">What is the current process to apply for a Green Card?<\/h1>\n<p dir=\"ltr\">The Green Card application process will vary depending on the applicant\u2019s situation.<\/p>\n<p dir=\"ltr\">Generally, in order to complete the <a href=\"https:\/\/www.uscis.gov\/green-card\/how-to-apply-for-a-green-card\">Green Card application process,<\/a> an applicant must file an immigrant petition form, which consists of someone else sponsoring or petitioning for the applicant. Some applicants may be eligible to petition themselves.<\/p>\n<p dir=\"ltr\">Once this form is approved, they must file a Green Card application, also known as a Form I-485 to USCIS.<\/p>\n<p dir=\"ltr\">Next, the applicant undergoes a biometrics appointment and an interview before an officer makes a final decision on the petition.<\/p>\n<p dir=\"ltr\">Under the newly-released policy memo, applicants must prove they meet \u201cextraordinary circumstances\u201d to apply for a green card in the U.S.<\/p>\n<h1 id=\"who-is-impacted-under-the-new-policy\" dir=\"ltr\">Who is impacted under the new policy?<\/h1>\n<p dir=\"ltr\">Experts say that it is unclear who will be impacted by the policy at this time.<\/p>\n<p dir=\"ltr\">Jeff Joseph, president of AILA, says it\u2019s not clear whether this policy will apply to future applications immediately or retroactively.<\/p>\n<p dir=\"ltr\"><a href=\"https:\/\/www.instagram.com\/p\/DY2KaJqAFFb\/\">Similarly, Dalal-Dheini<\/a> also says that it\u2019s unclear how strictly they will follow this policy, and who qualifies for exceptions.<\/p>\n<p dir=\"ltr\">Experts at the <a href=\"https:\/\/www.americanimmigrationcouncil.org\/blog\/green-card-news-uscis-memo\/\">American Immigration Council<\/a> say applicants who are immediate relatives of U.S. citizens or applicants from one of the 75 countries where consular processing is not currently available could be at a higher risk under the policy memo.<\/p>\n<p dir=\"ltr\">Dalal-Dheini also noted that redirecting cases to<a href=\"https:\/\/www.aila.org\/library\/featured-issue-new-policy-on-adjustment-of-status-as-act-of-extraordinary-discretion\"> \u201calready overburdened U.S. consulates\u201d<\/a> would create backlogs worldwide.<\/p>\n<p dir=\"ltr\">\u201cConsulates have been gutted by the administration, and they are already struggling.\u201d<\/p>\n<h1 id=\"what-do-experts-recommend\" dir=\"ltr\">What do experts recommend?<\/h1>\n<p dir=\"ltr\">Joseph recommends that people maintain their underlying immigration status, if possible.<\/p>\n<p dir=\"ltr\">He also suggests that Green Card holders or applicants should meet with an immigration lawyer if they have any status violations like overstaying a visa.<\/p>\n<p dir=\"ltr\"><em>Tara Mobasher es reportera y redactora del bolet\u00edn de Borderless Magazine.
