However, initial DACA requests remain on hold.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">An initial DACA request includes a first-time request, a request filed by someone who was previously granted DACA but missed the renewal deadline and a request filed by someone whose DACA grant was terminated.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Current DACA grants and accompanying employment authorization documents remain valid until they expire, unless they are terminated individually.\u00a0<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Applicants will receive a receipt of their initial request submission, and USCIS will then process the payment, but it is not issuing refunds at this time for pending initial DACA requests.<\/span><span style=\"font-weight: 400;\"> The renewal cost is $555, and the cost to file on paper is $605.\u00a0<\/span><\/p>\n<h2 id=\"why-have-there-been-delays-in-daca-applications\"><span style=\"font-weight: 400;\">Why have there been delays in DACA applications?<\/span><\/h2>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">DACA renewals may be taking longer at the moment because of the reinstatement of fingerprinting (biometrics) appointments, which were paused during the pandemic and require extra time to schedule and complete.<\/span><span style=\"font-weight: 400;\"> Additionally, cases of applicants <\/span><a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/12\/restricting-and-limiting-the-entry-of-foreign-nationals-to-protect-the-security-of-the-united-states\/\"><span style=\"font-weight: 400;\">from certain countries<\/span><\/a><span style=\"font-weight: 400;\"> are on hold while USCIS undergoes a comprehensive review process,<\/span><span style=\"font-weight: 400;\"> affecting thousands of applicants.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Every two years, DACA recipients must request a renewal of their status to continue receiving deportation relief and to work lawfully.\u00a0<\/span><\/p>\n<\/div>\n\n\n\n<div id=\"fws_6a0df8f13e562\" data-midnight=\"\" data-column-margin=\"default\" class=\"wpb_row vc_row-fluid vc_row processing time website<\/span><\/a><span style=\"font-weight: 400;\">, about 80% of renewal requests are processed within four months. They recommend that DACA recipients submit their renewal requests at least five months, but no later than four months, before their current DACA expires.\u00a0<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The expiration date is noted on the current approval notice, Form I-797. The expiration date on the work permit is the same date that DACA expires.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Applicants may be able to monitor the status of their case by using USCIS\u2019s <\/span><a href=\"https:\/\/egov.uscis.gov\/casestatus\/landing.do\"><span style=\"font-weight: 400;\">\u201cMy Case Status\u201d tool<\/span><span style=\"font-weight: 400;\"> on its website<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">What are attorneys recommending to clients whose DACA is expiring soon and whose renewal request is still pending?<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Flores said some of her clients are applying as early as USCIS recommends \u2014 up to five months before their expiration date \u2014 and are still not having their renewal request processed in time.\u00a0<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">To avoid a lapse in DACA, she now advises some clients to apply six to seven months before their DACA expiration date. Individuals can submit their request inquiry <\/span><a href=\"https:\/\/www.uscis.gov\/e-request\"><span style=\"font-weight: 400;\">here<\/span><\/a><span style=\"font-weight: 400;\"> using their Form I-765 receipt number.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">He also recommends that they reach out to their congressional representative to see what they can do.\u00a0<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">\u201cIt may not move the needle much, but at least that serves as a way to document the delay that this administration is creating and the direct impact on all these applicants,\u201d said Espinoza.<\/span><\/p>\n<h2 id=\"what-are-daca-recipients-rights-in-the-workplace\"><span style=\"font-weight: 400;\">What are DACA recipients&#8217; rights in the workplace?<\/span><\/h2>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">DACA recipients generally have the same rights as other employees in the workplace.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">DACA recipients are not required to tell their employers that they have DACA, so employers are not expected to know which of their employees, if any, have DACA.\u00a0<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">They should typically only be required to provide proof of work authorization at the time of hiring and when their work permit is expiring, according to the <\/span><a href=\"https:\/\/www.ilrc.org\/sites\/default\/files\/resources\/daca_workers_rights_guide_ilrc_uwd_afl-cio_oct_2020.pdf\"><span style=\"font-weight: 400;\">Immigrant Legal Resources Center<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">DACA recipients\u2019 employers verifying their work permit again when it is not set to expire could be a form of immigration discrimination under the Human Rights Act, according to Alexis Martin, a partner at employment law firm Caffarelli &amp; Associates Ltd.\u00a0<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">If and when their employer realizes that their work authorization has expired, they can terminate their employment.\u00a0<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">\u201c\u200b\u200bThey can be fired because the anti-discrimination statutes cannot compel an employer to <\/span><span style=\"font-weight: 400;\">violate federal law by employing a foreign national without authorization to work in the U.S.,\u201d said Martin.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Flores recommends that DACA recipients consult with an immigration attorney to determine whether there is an additional path to status that could provide work authorization and deportation relief, such as family-based petitions or asylum.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">\u201cWe really encourage people to maybe seek out consultations to see if there&#8217;s any other forms of relief to kind of protect [themselves] with all of the uncertainty that&#8217;s going on right now,\u201d she said.\u00a0<\/span><\/p>\n<p style=\"font-weight: 400;\"><i><span style=\"font-weight: 400;\">Aydali Campa is a Report for America corps member and covers environmental justice and immigrant communities for Borderless Magazine.
