Instead, they say the bill could add barriers for naturalized citizens casting their ballots.<\/p>\n<\/div>\n\n\n\n\n\t\t<div id=\"fws_69deab6aad1da\"  data-column-margin=\"default\" data-midnight=\"dark\"  class=\"wpb_row vc_row-fluid vc_row vc_row-o-equal-height vc_row-flex vc_row-o-content-middle large top_margin_20px bottom_margin_20px\"  style=\"padding-top: 0px; \" class=\"vc_col-sm-5 wpb_column column_container vc_column_container col child_column neg-marg no-extra-padding inherit_tablet inherit_phone \"   data-padding-pos=\"all\" data-has-bg-color=\"false\" data-bg-color=\"\" data-bg-opacity=\"1\" data-animation=\"\" data-delay=\"0\" >\n\t\t<div class=\"vc_column-inner\" >\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t\n\t<div class=\"wpb_raw_code wpb_raw_html wpb_content_element\" >\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<div class=\"_form_1\"><\/div><script src=\"https:\/\/borderlessmag.bluelena.io\/f\/embed.php?id=1\" charset=\"utf-8\"><\/script>\n\t\t<\/div>\n\t<\/div>\n\n\t\t<\/div> \n\t<\/div>\n\t<\/div> \n<\/div><\/div>\n\t\t\t<\/div> \n\t\t<\/div>\n\t<\/div> \n<\/div><\/div>\n\n<div class=\"wpb_text_column wpb_content_element \" >\n\t<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">\u201cThese illegal, over-broad attempts to restrict our rights are not the law yet, and so at every turn, we must assert our rights that we actually have now and keep defending them,\u201d said Ami Gandhi, a civil rights attorney with the nonpartisan Chicago Lawyers Committee for Civil Rights.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Borderless spoke with voter rights organizations and legal experts about the changes the bill could bring if passed, as well as its potential impact on immigrant voters.\u00a0<\/span><\/p>\n<h2 id=\"how-could-the-save-america-act-change-the-voting-process\"><span style=\"font-weight: 400;\">How could the SAVE America Act change the voting process?<\/span><\/h2>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Gandhi explained that the act, if passed, would:\u00a0<\/span><\/p>\n<ul style=\"font-weight: 400;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">require voters to bring documentary proof of U.S. citizenship, such as a passport or birth certificate, while registering,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">require states to share voter registration information with the Department of Homeland Security (DHS)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">and end online voter registration.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The SAVE America Act, if passed, would also require all voters casting their ballot by mail to register to <\/span><a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-bill\/22\/text\"><span style=\"font-weight: 400;\">vote in-person<\/span><\/a><span style=\"font-weight: 400;\"> and provide documentation proving their citizenship to an elections official.<\/span><\/p>\n<h2 id=\"how-could-this-impact-immigrant-voters\"><span style=\"font-weight: 400;\">How could this impact immigrant voters?<\/span><\/h2>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Gandhi said changes from the act could silence millions of eligible voters by creating barriers to voter registration \u2014 especially for immigrant communities and naturalized citizens.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">\u201cFor a first-time voter, the rules \u2026 can make a difference between whether someone sticks with the process \u2026 and whether they might not follow through with voting,\u201d Gandhi said.<\/span><\/p>\n<\/div>\n\n\n\n\n\t\t\t<\/div> \n\t\t<\/div>\n\t<\/div> \n\n\t<div  class=\"vc_col-sm-2 vc_hidden-sm vc_hidden-xs wpb_column column_container vc_column_container col no-extra-padding inherit_tablet inherit_phone flex_gap_desktop_10px \"  data-padding-pos=\"all\" data-has-bg-color=\"false\" data-bg-color=\"\" data-bg-opacity=\"1\" data-animation=\"\" data-delay=\"0\" >\n\t\t<div class=\"vc_column-inner\" >\n\t\t\t<div class=\"wpb_wrapper\">\n\t\t\t\t\n\t\t\t<\/div> \n\t\t<\/div>\n\t<\/div> \n<\/div><\/div>\n\t\t<div id=\"fws_69deab6ab19f5\"  data-column-margin=\"default\" data-midnight=\"dark\"  class=\"wpb_row vc_row-fluid vc_row  bottom_margin_0px\"  style=\"padding-top: 0px; Asian voters cast their ballot in this way at the highest rate of all racial groups, at 82%.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Tiwamangkala added that some voters who are naturalized citizens may struggle to get naturalization papers, passports or birth certificates to prove their citizenship due to cost and accessibility.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Christine Chen, executive director of Asian and Pacific Islander American (APIA) Vote, said naturalized Asian voters can also encounter clerical issues during voter registration that could affect their ability to vote under the proposed legislation.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Chen, who works with organizations nationwide to help register APIA voters, said she\u2019s seen names misspelled due to differences in English spellings or surname order.\u00a0<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Changes could also affect married women who take their spouse\u2019s last name, Chen said, since the legislation requires a person\u2019s name to match their birth certificates.<\/span><\/p>\n<h2 id=\"what-concerns-do-experts-have-about-sharing-voter-data-with-dhs\"><span style=\"font-weight: 400;\">What concerns do experts have about sharing voter data with DHS?<\/span><\/h2>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Gandhi said handing over voter lists to the federal government could lead to flawed citizenship checks that would exclude eligible naturalized immigrant voters.\u00a0<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">An <\/span><a href=\"https:\/\/www.texastribune.org\/2026\/02\/13\/save-voter-citizenship-tool-mistakes-confusion\/\"><span style=\"font-weight: 400;\">investigation by ProPublica and The Texas Tribune<\/span><\/a><span style=\"font-weight: 400;\"> found that the federal government\u2019s citizenship verification tool has led to \u201cwidespread misidentification\u201d of voter eligibility, especially for citizens born outside the U.S.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Under U.S. law, it is illegal for a noncitizen to vote in any election, and instances of voter fraud have accounted for an extremely small percentage \u2014 0.000008 percent \u2014 of votes cast in the last 11 presidential elections, according to a database by the conservative Heritage Foundation reported on by The <\/span><a href=\"https:\/\/www.nytimes.com\/2026\/03\/27\/us\/politics\/republican-voting-bill-save-act-fact-check.html\"><span style=\"font-weight: 400;\">New York Times<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Gandhi said the false rhetoric of widespread voter fraud chills voters from participating in elections.\u00a0<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">\u201c[Many voters] don\u2019t even necessarily want to take the chance or take the risk of going out there to a polling place or having their name on a voter registration application if they&#8217;re receiving the message that they will be scrutinized and interrogated about their citizenship and eligibility,\u201d Gandhi said.\u00a0<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Instead of changing voting rules, Chen said the federal government should focus on educating voters about the process and encouraging broader voter participation.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">\u201cA democracy is only a democracy when everyone who&#8217;s eligible is participating,\u201d she said.<\/span><\/p>\n<h2 id=\"is-there-any-legal-precedent-for-this-act\"><span style=\"font-weight: 400;\">Is there any legal precedent for this act?<\/span><\/h2>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">State legislators in Arizona passed a law in 2022 requiring voters to show documentary proof of citizenship, such as a passport or birth certificate, to register to vote.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Civil rights groups challenged the bill, and in 2025, a federal appeals court affirmed a lower court ruling against the legislation, essentially stating \u201c<\/span><a href=\"https:\/\/www.brennancenter.org\/our-work\/research-reports\/mi-familia-vota-v-fontes\"><span style=\"font-weight: 400;\">that Arizonans who do not provide proof of citizenship may continue to vote in all federal elections<\/span><\/a><span style=\"font-weight: 400;\">,\u201d according to the Brennan Center for Justice, an independent, nonpartisan legal organization that was part of the litigation against the bill.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The case, Mi Familia Vota v. Fontes, is still being litigated.<\/span><\/p>\n<h2 id=\"what-do-immigrants-need-to-know-when-voting\"><span style=\"font-weight: 400;\">What do immigrants need to know when voting?<\/span><\/h2>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The SAVE America Act has not yet passed and is not law.
