Orozco said that with rising backlogs, USCIS will likely not be able to process renewal applications in time for people to receive authorization before their work permits expire.<\/p>\n<p>Without work permits, immigrants may lose other benefits tied to employment authorization, such as their driver\u2019s license or Social Security number (SSN).<\/p>\n<p>Legal experts said the change is part of a broader pattern of how immigration agencies, under the Trump administration, are figuring out ways to \u201cmake life untenable for immigrants\u201d to push them to \u201cgive up their cases and waive their rights.\u201d<\/p>\n<p>\u201cThe reality is that most of these people are eligible for this benefit [of renewing their work permits],\u201d said Lisa Koop, national director of legal services for the National Immigrant Justice Center. \u201cThis new policy serves only to prevent them from accessing benefits to which they&#8217;re entitled.\u201d<\/p>\n<p>Borderless Magazine spoke with immigration law experts to compile guidance on what you should know about the changes to the work permit renewal application, or Form I-765, and how they could impact immigrant workers and the economy.<\/p>\n<p><i>This article is for educational and informational purposes only and should not be construed as legal advice.<\/i><\/p>\n<h2 id=\"whats-changing-with-the-work-permit-renewal-process\">What\u2019s changing with the work permit renewal process?<\/h2>\n<p>Before the new rule took effect on Oct. 30, certain applicants filing work permit renewal requests were eligible for an automatic 540-day extension. This would ensure they could continue working while their renewal application was being processed.<\/p>\n<p>The new federal rule ended the automatic extensions of work permits, also known as Employment Authorization Documents (EADs). USCIS did not explain how processing times would be shortened to prevent gaps in lawful employment for applicants awaiting approval.<\/p>\n<p>\u201cUSCIS, <a href=\"https:\/\/egov.uscis.gov\/processing-times\/\">in their web page<\/a>, is reporting that [the work permit processing time] is 6.5 months for a pending asylum application,\u201d Koop said. \u201cWe&#8217;re seeing them take much longer than that.\u201d<\/p>\n<p>Enrique Espinoza, a staff attorney at Illinois Tech Chicago-Kent College of Law, said the changes leave working immigrants at the mercy of USCIS\u2019s long processing times. Based on his experience, applications have often taken longer than six months to process,\u00a0which is the earliest recommended time for immigrants to submit their renewals.<\/p>\n<p>\u201cThe government needs to show that they&#8217;re going to be capable to process all these applications timely, so that the workforce will not be impacted by it,\u201d said Espinoza. \u201cI hope that they do. padding-bottom: 0px; \"><div class=\"row-bg-wrap\" data-bg-animation=\"none\" data-bg-animation-delay=\"\" data-bg-overlay=\"false\"><div class=\"inner-wrap row-bg-layer\" ><div class=\"row-bg viewport-desktop\"  style=\"\"><\/div><\/div><\/div><div class=\"row_col_wrap_12 col span_12 dark left\">\n\t<div  class=\"vc_col-sm-2 vc_hidden-sm vc_hidden-xs wpb_column column_container vc_column_container col no-extra-padding inherit_tablet inherit_phone \"  data-padding-pos=\"all\" data-has-bg-color=\"false\" data-bg-color=\"\" data-bg-opacity=\"1\" data-animation=\"\" data-delay=\"0\" >\n\t\t<div class=\"vc_column-inner\" >\n\t\t\t<div class=\"wpb_wrapper\">\n\t\t\t\t\n\t\t\t<\/div> \n\t\t<\/div>\n\t<\/div> \n\n\t<div  class=\"vc_col-sm-8 wpb_column column_container vc_column_container col padding-3-percent inherit_tablet inherit_phone \"  data-padding-pos=\"all\" data-has-bg-color=\"false\" data-bg-color=\"\" data-bg-opacity=\"1\" data-animation=\"\" data-delay=\"0\" >\n\t\t<div class=\"vc_column-inner\" >\n\t\t\t<div class=\"wpb_wrapper\">\n\t\t\t\t\n<div class=\"wpb_text_column wpb_content_element \" >\n\t<p>As of October, <a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/data\/appropriation_requirement_september%202025.csv\">more than 900,000<\/a> work permit applications had been pending for over six months, according to USCIS data.<\/p>\n<h2 id=\"who-will-this-affect\">Who will this affect?<\/h2>\n<p>All <a href=\"https:\/\/www.uscis.gov\/archive\/automatic-employment-authorization-document-ead-extension\">18 categories<\/a> of immigrants who were previously eligible for automatic extensions will no longer have automatic extensions after filing renewal applications, including:<\/p>\n<ul>\n<li aria-level=\"1\">Refugees<\/li>\n<li aria-level=\"1\">People who have been granted asylum<\/li>\n<li aria-level=\"1\">People with pending asylum applications<\/li>\n<li aria-level=\"1\">Violence Against Women Act (VAWA) Self-Petitioners<\/li>\n<\/ul>\n<p>Nearly nine in 10 pending renewal requests fall under categories that are covered by the new rule, according to <a href=\"https:\/\/www.uscis.gov\/tools\/reports-and-studies\/immigration-and-citizenship-data?topic_id%5B%5D=33682&amp;topic_id%5B%5D=33599&amp;topic_id%5B%5D=33631&amp;topic_id%5B%5D=33674&amp;topic_id%5B%5D=33737&amp;topic_id%5B%5D=33628&amp;topic_id%5B%5D=33614&amp;topic_id%5B%5D=33685&amp;topic_id%5B%5D=33615&amp;topic_id%5B%5D=33686&amp;topic_id%5B%5D=33687&amp;topic_id%5B%5D=33690&amp;topic_id%5B%5D=33691&amp;topic_id%5B%5D=33701&amp;ddt_mon=&amp;ddt_yr=&amp;query=&amp;items_per_page=10\">USCIS data<\/a> analyzed by the <a href=\"https:\/\/www.americanimmigrationcouncil.org\/blog\/uscis-ends-automatic-extensions-for-work-permits\/\">American Immigration Council<\/a> (AIC). However, the rule will only impact renewals filed on or after Oct. 30.<\/p>\n<p>The new policies will also impact employers, said Orozco, with AIC.<\/p>\n<p>Employers have already had to navigate a variety of work eligibility changes under the Trump administration, Orozco said. With the potential lapses in work permits, Orozco said employers may have to invest more time and training in navigating immigrants\u2019 differing work eligibility.<\/p>\n<p>\u201cThis is causing not only potential gaps in the labor force, but also so much more investment in time around employers&#8217; If someone was previously approved for a work permit, they would have already given biometric information, such as their pictures and fingerprints, that USCIS can use for background checks, Orozco said.<\/p>\n<p>\u201cThe agency already has all the tools that it needs to properly vet individuals, and I don&#8217;t think that it was properly supported in the rule to indicate that there&#8217;s really a grave concern here,\u201d Orozco said.<\/p>\n<h2 id=\"what-should-i-do-if-my-work-permit-is-expiring-soon\">What should I do if my work permit is expiring soon?<\/h2>\n<p>Espinoza recommends applying for a renewal as soon as someone is eligible to, which is six months before their current permit expires.<\/p>\n<p>\u201cIt is better to be ready than not in these particular situations,\u201d he said.<\/p>\n<p>He cautioned against submitting renewal applications earlier than six months, since, based on his experience, those applications are more likely to be rejected for filing \u201ctoo soon.\u201d<\/p>\n<p>USCIS\u2019s website also recommends <a href=\"https:\/\/www.uscis.gov\/i-765\">not filing a request to renew<\/a> more than 180 days, or roughly six months, before a work permit&#8217;s expiration.<\/p>\n<p>To expedite the processing of certain work permit applications, individuals have the option to complete Form I-907, the \u201cRequest for Premium Processing Service.\u201d However, the form costs $1,685 to file and doesn\u2019t guarantee that someone\u2019s application will be processed before their current permit expires, Espinoza said.<\/p>\n<p>Applicants are also able to call USCIS customer service to ask to <a href=\"https:\/\/www.uscis.gov\/forms\/filing-guidance\/expedite-requests\">expedite their case<\/a> if they\u2019ve already submitted their renewal application and it hasn\u2019t been processed yet.<\/p>\n<p>However, Koop said her organization has not seen success with calling customer service to expedite the processing of an application.<\/p>\n<p>\u201cWe&#8217;ve spent months and months \u2026 doing all of the things one can try in order to get an EAD expedited, and those things do not work, particularly when you have an administration that is now designed and set up to deny applications,\u201d Koop said. \u201cTheir objective is not to find applications to approve.\u201d<\/p>\n<p>To estimate how long an application could take to be processed, applicants can visit the <a href=\"https:\/\/egov.uscis.gov\/processing-times\/\">USCIS website,<\/a> which lists estimated wait times based on status.<\/p>\n<h2 id=\"is-this-change-final\">Is this change final?<\/h2>\n<p>The new rules went into effect immediately; however, the public can <a href=\"https:\/\/www.regulations.gov\/commenton\/USCIS-2025-0271-0001\">submit a comment <\/a>about the changes until Dec. 1.<\/p>\n<p>According to Orozco, having documented comments about the impacts of these policy changes can help strengthen efforts to challenge them in court.<\/p>\n<p>\u201cUnder the law, the government should take into account the comments and \u2026 reliance that people have had on this rule,\u201d Orozco said. \u201cIf the community is able to document that and send those comments into the government, the government can&#8217;t just ignore those \u2014 or if it does, then that makes the litigation even stronger.\u201d<\/p>\n<p>Espinoza said individuals can conduct a personal risk assessment before deciding whether to submit a public comment about the rule, taking into account their status and willingness to share their name publicly.<\/p>\n<p>Individuals who are U.S. citizens, for example, may face less risk when speaking up publicly against these changes than those who don\u2019t have legal status, Espinoza said.<\/p>\n<p>\u201cDepending on which status you have, the more risk or less risk you will have,\u201d Espinoza said. \u201cAnd that&#8217;s what is important, that the community as a whole collaborate.\u201d<\/p>\n<p><i>Katrina Pham is Borderless Magazine\u2019s audience engagement reporter.
