South Shore Drive, that are part of \u201cOperation Midway Blitz,\u201d have left community members dealing with damage to personal belongings and the disappearances of friends and family.<\/p>\n<\/div>\n\n\n\n\n\t\t<div id=\"fws_69e90734b4e6f\"  data-column-margin=\"default\" data-midnight=\"dark\"  class=\"wpb_row vc_row-fluid vc_row vc_row-o-equal-height vc_row-flex vc_row-o-content-middle large top_margin_20px bottom_margin_20px\"  style=\"padding-top: 0px; \" class=\"vc_col-sm-5 wpb_column column_container vc_column_container col child_column neg-marg no-extra-padding inherit_tablet inherit_phone \"   data-padding-pos=\"all\" data-has-bg-color=\"false\" data-bg-color=\"\" data-bg-opacity=\"1\" data-animation=\"\" data-delay=\"0\" >\n\t\t<div class=\"vc_column-inner\" >\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t\n\t<div class=\"wpb_raw_code wpb_raw_html wpb_content_element\" >\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<div class=\"_form_1\"><\/div><script src=\"https:\/\/borderlessmag.bluelena.io\/f\/embed.php?id=1\" charset=\"utf-8\"><\/script>\n\t\t<\/div>\n\t<\/div>\n\n\t\t<\/div> \n\t<\/div>\n\t<\/div> \n<\/div><\/div>\n\t\t\t<\/div> \n\t\t<\/div>\n\t<\/div> \n<\/div><\/div>\n\n<div class=\"wpb_text_column wpb_content_element \" >\n\t<p>As federal agents use increasingly aggressive tactics, many Chicagoans are questioning the limits of federal authority and whether agents can be held accountable for property damage and potential civil rights violations.<\/p>\n<p>\u201cThe difficulty here is that a lot of times the law is here to address a problem that has already happened,\u201d said Ryann Moran, a supervising attorney for the Law Center for Better Housing (LCBH).<\/p>\n<p>Housing rights organizers are encouraging community members to connect with their neighbors and form coalitions to prepare and defend one another in the event of a raid.<\/p>\n<p>\u201cAn apartment building can be defended in a way that you can&#8217;t defend \u2026 people that are on their way to work, going out to the laundromat [or] going to do the daily things they need to do,\u201d said Danny Rosa, an organizer with the All-Chicago Tenant Alliance (ACTA).<\/p>\n<p>Borderless spoke with legal experts and housing rights organizers for tips on how to prepare and respond to interactions with Immigration and Customs Enforcement (ICE) and other federal agents, as well as what community members can do if agents damage their property.<\/p>\n<p><i>This article is for educational and informational purposes only and should not be construed as legal advice.<\/i><\/p>\n<\/div>\n\n\n\n\n\t\t\t<\/div> \n\t\t<\/div>\n\t<\/div> \n\n\t<div  class=\"vc_col-sm-2 vc_hidden-sm vc_hidden-xs wpb_column column_container vc_column_container col no-extra-padding inherit_tablet inherit_phone \"  data-padding-pos=\"all\" data-has-bg-color=\"false\" data-bg-color=\"\" data-bg-opacity=\"1\" data-animation=\"\" data-delay=\"0\" >\n\t\t<div class=\"vc_column-inner\" >\n\t\t\t<div class=\"wpb_wrapper\">\n\t\t\t\t\n\t\t\t<\/div> \n\t\t<\/div>\n\t<\/div> \n<\/div><\/div>\n\t\t<div id=\"fws_69e90734b7247\"  data-column-margin=\"default\" data-midnight=\"dark\"  class=\"wpb_row vc_row-fluid vc_row\"  style=\"padding-top: 0px; They are also not allowed to discriminate against a tenant based on their citizenship or perceived citizenship.<\/p>\n<p>Unless you live in federally subsidized housing, you do not have to share your immigration status with your landlord.<\/p>\n<p>Moran said landlords may be able to ask you other questions that may help them guess your status, including whether you\u2019ll be able to afford the apartment.\u00a0But explicitly asking for your status is unlawful, she said.<\/p>\n<h2 id=\"what-can-i-do-if-my-landlord-threatens-to-call-ice-on-me\">What can I do if my landlord threatens to call ICE on me?<\/h2>\n<p>It is illegal for your landlord to threaten to call immigration agents on you under the Immigrant Tenant Protection Act.<\/p>\n<p>If your landlord threatens to call ICE on you, you have the right to sue for damages in court.<\/p>\n<p>To help build your case, experts recommend that you:<\/p>\n<ul>\n<li aria-level=\"1\">Document threats made in writing by screenshotting and saving texts or email exchanges.<\/li>\n<\/ul>\n<ul>\n<li aria-level=\"1\">Seek out witnesses.\n<ul>\n<li aria-level=\"2\">Verbal threats are harder to prove, but having someone who can corroborate your account can help.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>Do not:<\/p>\n<ul>\n<li aria-level=\"1\">Record conversations with your landlord or other people in your building without securing consent from everyone being recorded.\n<ul>\n<li aria-level=\"2\">Illinois\u2019 current <a href=\"https:\/\/www.ilga.gov\/documents\/legislation\/ilcs\/documents\/072000050K14-1.htm\">eavesdropping law<\/a> prohibits recording a \u201cprivate conversation\u201d without the consent of all parties.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>You can also report threats and intimidation by landlords to mutual aid groups or local officials.<\/p>\n<ul>\n<li aria-level=\"1\">For tenants throughout Chicago:\n<ul>\n<li aria-level=\"2\">Call the Metropolitan Tenants Organization\u2019s hotline: 773-292-4988 (available on weekdays from 1 p.m. to 5 p.m.)<\/li>\n<\/ul>\n<\/li>\n<li aria-level=\"1\">For Albany Park\/Northwest Side residents:\n<ul>\n<li aria-level=\"2\">Call the Autonomous Tenants Union\u2019s hotline: 872-216-5288<\/li>\n<\/ul>\n<\/li>\n<li aria-level=\"1\">To make a general report of misconduct to city officials:\n<ul>\n<li aria-level=\"2\">Contact your local alderperson: <a href=\"https:\/\/www.chicago.gov\/city\/en\/depts\/mayor\/iframe\/lookup_ward_and_alderman.html\">Find them here<\/a><\/li>\n<li aria-level=\"2\">Call 311 to report a landlord violation and access general support if you\u2019ve been displaced.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2 id=\"what-are-my-rights-if-ice-or-other-federal-immigration-agents-enter-my-apartment-building\">What are my rights if ICE or other federal immigration agents enter my apartment building?<\/h2>\n<p>Common or shared areas, such as courtyards or lobbies, can be more challenging to secure as they are accessible to everyone in the building.<\/p>\n<p>The inside of your apartment is considered a private area, so you have the right to refuse entry to federal immigration officers unless they have a signed judicial warrant with your name on it.<\/p>\n<p>A valid judicial or criminal warrant is:<\/p>\n<ul>\n<li aria-level=\"1\">Created by a court;<\/li>\n<li aria-level=\"1\">Signed by a judge; and<\/li>\n<li aria-level=\"1\">Has your full legal name.<\/li>\n<\/ul>\n<p>An administrative immigration warrant is not signed by a judge and is created by the Department of Homeland Security (DHS) or an ICE officer, according to an emailed statement from Jonathan Meyer, former DHS general counsel and leader of the national security team for Sheppard Mullin law firm.<\/p>\n<p>\u201cThe easiest way to tell them apart is to look for a judge\u2019s signature,\u201d Meyer said.<\/p>\n<p>There are risks to refusing entry to immigration officers, Meyer added. Officers can wait in the neighborhood to detain someone or launch an investigation into a landlord.<\/p>\n<h2 id=\"as-a-landlord-do-i-have-to-share-information-about-my-tenants-if-federal-agents-ask-for-it\">As a landlord, do I have to share information about my tenants if federal agents ask for it?<\/h2>\n<p>Meyer said there is no simple answer to whether a landlord must cooperate with a federal agent\u2019s requests. Landlords and tenants should talk to a lawyer or legal expert if federal agents request information from them, he said.<\/p>\n<p>\u201cGenerally speaking, landlords have an obligation [to] try to protect the privacy of their tenants to the greatest extent possible,\u201d Meyer said. \u201cBut there may be situations where some cooperation is warranted.\u201d<\/p>\n<h2 id=\"what-can-i-do-if-federal-agents-damage-my-property\">What can I do if federal agents damage my property?<\/h2>\n<p>Meyer said there are processes available through both DHS and the courts to obtain compensation if someone\u2019s property has been damaged by federal agents.<\/p>\n<p>Under the Federal Tort Claims Act, you can either:<\/p>\n<ul>\n<li aria-level=\"1\">File a claim directly to the agency responsible, such as <a href=\"https:\/\/www.ice.gov\/about-ice\/opla\/ftca\">ICE<\/a> or Customs and Border Patrol (<a href=\"https:\/\/www.helpspanish.cbp.gov\/s\/article\/Article-1394?language=en_US\">CBP<\/a>); In those situations, tenants have typically been responsible for clean-up,\u00a0not landlords or government agencies.<\/p>\n<p>Whether tenants are required to clean up property damage caused by federal law enforcement is unclear, Moran said, but she would generally presume that the tenant is expected to cover the costs for damages.<\/p>\n<h2 id=\"is-there-any-way-for-tenants-and-landlords-to-protect-themselves-from-raids-or-property-damage\">Is there any way for tenants and landlords to protect themselves from raids or property damage?<\/h2>\n<p>Rosa, with ACTA, said one way tenants can make their buildings safer and better places to live is by creating a tenants\u2019 union.<\/p>\n<p>If community members are interested in getting organized, Rosa said they can start by:<\/p>\n<ul>\n<li aria-level=\"1\">Talking to their neighbors to get connected.<\/li>\n<li aria-level=\"1\">Creating a group chat (using platforms like WhatsApp or text group chats) to share information and make security plans.<\/li>\n<li aria-level=\"1\"><a href=\"https:\/\/docs.google.com\/forms\/d\/e\/1FAIpQLScQQUHLd0EjBhbYM2uEUwU4ZaAFC2z8RsEy7quAJaeM0dt6Ow\/viewform\">Contacting ACTA <\/a>for support.<\/li>\n<\/ul>\n<p>He added that unionized tenants can protect their neighbors from ICE threats by:<\/p>\n<ul>\n<li aria-level=\"1\">Creating security plans in case of ICE presence.<\/li>\n<li aria-level=\"1\">Designating volunteer community members as security escorts and lookouts.<\/li>\n<li aria-level=\"1\">Negotiating with landlords to ensure the building\u2019s entrances are secure.<\/li>\n<\/ul>\n<p><i>Katrina Pham is Borderless Magazine\u2019s audience engagement reporter.
