Many of them waiting for asylum approval; others seeking life-saving treatment for HIV.<\/p>\n<p>Over the last seven months, LGBTQ+ immigrants have faced a wave of legislation and policies that many of them argue is making it harder to get basic care. Still, community groups continue to provide resources and preserve spaces of support amid dozens of executive orders and increased ICE detention.<\/p>\n<h2 id=\"trumps-anti-lgbtq-and-immigrant-policies\">Trump\u2019s anti-LGBTQ+ and Immigrant policies<\/h2>\n<p>Since his inauguration, President Donald Trump has signed a slew of executive orders taking aim at LGBTQ+ rights and immigration. Among some of Trump\u2019s initial orders that could impact LGBTQ+ immigrants are:<\/p>\n<ul>\n<li aria-level=\"1\">federal agencies <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/defending-women-from-gender-ideology-extremism-and-restoring-biological-truth-to-the-federal-government\/\">only recognizing<\/a> two genders that would be assigned at birth in all of their messaging and policies and end funding of &#8220;gender ideology\u201d<\/li>\n<li aria-level=\"1\"><a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/protecting-children-from-chemical-and-surgical-mutilation\/\">directing agencies<\/a> to take steps to limit youth access to gender-affirming care;<\/li>\n<li aria-level=\"1\">shutting down the by the Substance Abuse and Mental Health Services Administration\u2019s <a href=\"https:\/\/www.nbcnews.com\/nbc-out\/out-news\/trump-shuts-down-lgbtq-youth-suicide-hotline-rcna219090\">LGBTQ suicide hotline;<\/a><\/li>\n<li aria-level=\"1\"><a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/02\/keeping-men-out-of-womens-sports\/\">withholding federal funding<\/a> from institutions that allow transgender athletes to participate in sports; and<\/li>\n<li aria-level=\"1\">expansive immigration-related policy changes that included immediate apprehension at the border and <a href=\"https:\/\/borderlessmag.org\/2025\/02\/04\/afghan-asylum-seekers-cbp-one-shut-down-mexico-uncertainty-trump-immigrants\/\">eliminated \u201cCBP One,\u201d<\/a> which previously allowed asylum seekers to schedule appointments at ports of entry.<\/li>\n<\/ul>\n<p>Several states have filed lawsuits against these executive orders. <a href=\"https:\/\/illinoisattorneygeneral.gov\/News-Room\/Current-News\/D.Mass._1_25-cv-12162_1_0.pdf?language_id=1\">Illinois recently joined over a dozen states in a lawsuit<\/a> , which aims to <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/protecting-children-from-chemical-and-surgical-mutilation\/\">eliminate youth access to gender-affirming care.<\/a>.<\/p>\n<p>Organizations serving the LGBTQ+ community are also challenging Trump\u2019s agenda, while juggling new challenges providing additional support and resources in these moments.<\/p>\n<p>\u201c[Trump\u2019s policies] have added layers of counseling that we have to do to clients,\u201d said Bridget Crawford, director of law and policy at <a href=\"https:\/\/immigrationequality.org\/get-involved\/?gad_source=1&amp;gad_campaignid=13609331948&amp;gbraid=0AAAAADjVczQGXrapVWiKpUv1OVvbq8EFU&amp;gclid=CjwKCAjw_pDBBhBMEiwAmY02NuuAZVnY4biYvoIU3hHUSZbTw45eUKTomIOhQH20HSHy1ooQSZ-4jhoCJkwQAvD_BwE\">Immigration Equality<\/a>. \u201cAgain, there is a lot of uncertainty.&#8221;<\/p>\n<\/div>\n\n\n\n\n\t\t\t<\/div> \n\t\t<\/div>\n\t<\/div> \n\n\t<div  class=\"vc_col-sm-2 vc_hidden-sm vc_hidden-xs wpb_column column_container vc_column_container col no-extra-padding inherit_tablet inherit_phone \"  data-padding-pos=\"all\" data-has-bg-color=\"false\" data-bg-color=\"\" data-bg-opacity=\"1\" data-animation=\"\" data-delay=\"0\" >\n\t\t<div class=\"vc_column-inner\" >\n\t\t\t<div class=\"wpb_wrapper\">\n\t\t\t\t\n\t\t\t<\/div> \n\t\t<\/div>\n\t<\/div> \n<\/div><\/div>\n\t\t<div id=\"fws_69da4d436886a\"  data-column-margin=\"default\" data-midnight=\"dark\"  class=\"wpb_row vc_row-fluid vc_row\"  style=\"padding-top: 0px; The organization was heavily involved in referring LGBTQ+ refugees to the U.S. Refugee Admissions Program (USRAP), which the<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/realigning-the-united-states-refugee-admissions-program\/\"> Trump administration suspended in January<\/a>.<\/p>\n<p>Immigration Equality and AHF are part of countless organizations nationwide serving the LGBTQ+ and immigrant community that are trying to fill the gaps in healthcare access and legal support left by policies put in place by the Trump administration.<\/p>\n<p>At AHF, the foundation has implemented telehealth services for patients who don\u2019t feel comfortable visiting the clinic in person because of fears of encountering ICE. Ramirez says they hope this option helps people feel safe enough to seek the treatment they need despite fears about their legal status.<\/p>\n<p>Meanwhile, other groups have expanded their services and resources to support the LGBTQ+ immigrant community in Chicago.<\/p>\n<p><a href=\"https:\/\/lifeiswork.org\">Life is Work,<\/a> a trans-led organization that serves LGBTQ+ communities on Chicago\u2019s West Side, has become a resource for political education, regardless of sexual orientation or legal status. To be eligible for asylum in the United States, an individual must show a \u201cwell-founded fear of persecution in their home country based on their race, religion, nationality, political opinion or membership in a particular social group,\u201d according to U.S. <a href=\"https:\/\/www.uscis.gov\/humanitarian\/refugees-and-asylum\/asylum\">Citizenship and Immigration Services<\/a>.<a href=\"https:\/\/immigrationequality.org\/legal\/legal-help\/asylum\/case-law\/#:~:text=Matter%20of%20Toboso%2DAlfonso%2020%20I&amp;N%20Dec.&amp;text=1990)%20%E2%80%94%20the%20original%20case%2C,participate%20in%20a%20labor%20camp.\">.\u00a0<\/a><\/p>\n<p>Since returning to office, the Trump administration has made it more difficult for trans immigrants to obtain visas.<\/p>\n<p>On his first day in office, Trump signed an executive order directing officers to deny visas based on a finding of<a href=\"https:\/\/www.seyfarth.com\/news-insights\/new-visa-restrictions-target-transgender-athletes-raising-title-ix-and-compliance-concerns-for-colleges.html\"> \u201cmaterial misrepresentations related to an applicant\u2019s sex or purpose of travel.\u201d<\/a> The <a href=\"https:\/\/www.seyfarth.com\/news-insights\/new-visa-restrictions-target-transgender-athletes-raising-title-ix-and-compliance-concerns-for-colleges.html\">new restrictions<\/a> also require applicants to provide further evidence, like birth certificates, to show their assigned sex at birth, adding further complexity to the visa process. The order was <a href=\"https:\/\/www.uscis.gov\/newsroom\/news-releases\/uscis-updating-policy-to-protect-womens-sports\">updated by USCIS<\/a> at the beginning of this month.<\/p>\n<p>The State Department previously <a href=\"https:\/\/transequality.org\/documents\/know-your-rights-passports#:~:text=Prior%20to%20Donald%20Trump's%20issuance,eliminate%20the%20%E2%80%9CX%E2%80%9D%20designation.\">allowed people to change their sex designation<\/a> on passports to match their gender identity. Trump issued the executive order suspending the policy, resulting in <a href=\"https:\/\/www.aclu.org\/cases\/orr-v-trump#press-releases\">some people with pending passport applications<\/a> having their passports withheld from them or others receiving new documentation with the wrong sex designation.<\/p>\n<p><a href=\"https:\/\/www.aclu.org\/press-releases\/transgender-and-nonbinary-people-take-trump-to-court-over-passport-restrictions#:~:text=The%20ACLU%20has%20been%20contacted%20through%20its,get%20passports%20that%20accurately%20reflect%20their%20identity.&amp;text=Soon%20after%2C%20the%20ACLU%20sued%20on%20behalf,constitutional%20rights%20and%20the%20Administrative%20Procedure%20Act.\">More than 1,500 transgender people or relatives<\/a> have contacted the American Civil Liberties Union (ACLU) for legal support, many of whom have had their passport applications suspended or are still pending, and are concerned about getting documents that accurately reflect their identity.<\/p>\n<p>Legal advocates and organizations have been pushing back both in the courtroom and on the streets. <a href=\"https:\/\/www.aclu.org\/press-releases\/transgender-and-nonbinary-people-take-trump-to-court-over-passport-restrictions\">The ACLU of Massachusetts is challenging the order barring people from updating their sex designation on passports in federal court<\/a>. The lawsuit challenges Trump\u2019s policy that requires passports to list the individual\u2019s sex assigned at birth and rejects designations that say, \u2018X.\u2019 A federal court judge offered relief and now allowed<a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/passports\/passport-help\/sex-marker.html\"> eligible individuals to correct their sex designations.<\/a><\/p>\n<p>\u201cWe have a couple of transgender women who were so relieved and grateful to reach the United States because they were afraid they were going to die in their home country,\u201d Crawford said. \u201cThen to come here and see this vitriol, I think it\u2019s really hard to watch.\u201d<\/p>\n<p>Travis Hooker, executive director of the LGBT Chamber of Commerce of Illinois, said that despite the funding cuts, they\u2019ve seen an increase in support from individuals hoping to oppose the administration.<\/p>\n<p>\u201cAfter the election, we had such a drawback in corporate sponsorship,\u201d Hooker said. \u201cIt has made things difficult\u2026we have more people involved from smaller companies, and that is our bread and butter.\u201d<\/p>\n<p>Leaders of these organizations say they\u2019ll continue to fight despite funding drawbacks and fears of the administration\u2019s upcoming moves.<\/p>\n<p>Crawford says that she\u2019s encouraged and motivated by the community\u2019s bravery.<\/p>\n<p>\u201cOn the one hand, it is really disheartening to see these actions and the impact they have on our clients that came here for protection and safety,\u201d she said. \u201cAt the same time, you see these acts of bravery and people who are able to overcome adversity in yet another country.
