Now, in the first seven months of his second term, old protections for immigrants have been ripped up as new, restrictive rules have been rolled out, and judicial officers are being fired.<\/p>\n<p>\u201cThere has just been an onslaught of change from day one of this administration,\u201d said Shannon Shepherd, a veteran immigration lawyer in Chicago. She has, especially, been struck by how the government\u2019s court actions \u201cseem harsher and crueler.\u201d<\/p>\n<h2 id=\"profound-changes\">Profound Changes<\/h2>\n<p>The White House <a href=\"https:\/\/www.americanimmigrationcouncil.org\/fact-sheet\/after-day-one-high-level-analysis-trumps-first-executive-actions\/\">strategy<\/a> has been to sweep more immigrants into the courts and then speed them through the system, while spinning a broader and less forgiving enforcement aimed at the<a href=\"https:\/\/www.pewresearch.org\/short-reads\/2024\/07\/22\/what-we-know-about-unauthorized-immigrants-living-in-the-us\/\"> estimated 11 million undocumented immigrants <\/a>in the U.S.<\/p>\n<p>Some of the changes sought by the government have included:<\/p>\n<ul>\n<li aria-level=\"1\">Wiping out free legal <a href=\"https:\/\/www.immdef.org\/blog\/ucphearing3\">counsel f<\/a>or an estimated 26,000 unaccompanied minors;<\/li>\n<li aria-level=\"1\">Allowing immigration court judges to decide whether immigrants are eligible for asylum <a href=\"https:\/\/www.aila.org\/eoir-issues-policy-memo-on-pretermission-of-legally-insufficient-asylum-applications\">without<\/a> holding a hearing; and<\/li>\n<li aria-level=\"1\">Closing three <a href=\"https:\/\/democracyforward.org\/wp-content\/uploads\/2025\/04\/1-RFK-v.-DHS-complaint.pdf\">ombudsman<\/a> offices that monitor the immigration courts, detention facilities and law enforcement\u2019s treatment of immigrants.<\/li>\n<\/ul>\n<p>The result has been a 3.4 million-case<a href=\"https:\/\/tracreports.org\/phptools\/immigration\/backlog\/\"> backlog<\/a> nationally as of June, more than twice the backlog for all of 2021. Similarly, <a href=\"https:\/\/tracreports.org\/phptools\/immigration\/backlog\/\">Chicago\u2019<\/a>s Immigration Court had over 222,000 backlogged cases, five times the number in 2020.<\/p>\n<p>Outside of the courts, Immigration and Customs Enforcement (ICE) arrests have grown nationally by <a href=\"https:\/\/www.nytimes.com\/interactive\/2025\/06\/27\/us\/ice-arrests-trump.html\">124% and 98% in Illinois in June<\/a>, according to an analysis by the New York Times. That same month, <a href=\"https:\/\/tracreports.org\/immigration\/detentionstats\/pop_agen_table.html\">57,861 immigrants<\/a> were held in detention centers across the U.S.\u2014 the highest number on record since 2019. Previously, immigrants could only be removed if they had been in the country for 14 days and apprehended within 100 miles of a U.S. border.<\/p>\n<p>In these instances, a court hearing is<a href=\"https:\/\/nipnlg.org\/work\/resources\/practice-alert-protecting-noncitizens-expedited-removal-and-immigration-court\"> not required<\/a> unless immigrants explicitly cite fears of where they might be <a href=\"https:\/\/www.nilc.org\/resources\/know-your-rights-expedited-removal-expansion\/\">deported,<\/a> a fact most immigrants do not know, attorneys say.<\/p>\n<p>Amid the sweeping enforcement practices, the EOIR <a href=\"https:\/\/www.aila.org\/library\/eoir-rescinds-and-cancels-oppm-on-enforcement-actions-in-or-near-ocij-space\">lifted<\/a> a ban on enforcement actions in or near immigration courts. In recent months, ICE agents began <a href=\"https:\/\/borderlessmag.org\/2025\/06\/03\/ice-arrests-chicago-immigration-court-trump-detention-immigration-custom-enforcement\/\">making arrests after cases were dismissed in Chicago<\/a> and several other courtrooms nationwide.<\/p>\n<p>On multiple occasions, Borderless reporters witnessed federal officers detain immigrants immediately after their cases were dismissed.<\/p>\n<p>This process caught a long-time immigration lawyer off guard. But as the lawyer exited the courtroom and turned back, he was stunned to see his client being led away by ICE agents.<\/p>\n<p>He has not spoken up publicly since the incident, he said, outside a courtroom in May.<\/p>\n<p>\u201cI don\u2019t want to make trouble. This court has ways of getting back at you,\u201d he explained.<\/p>\n<h2 id=\"cracking-down-on-the-courts\">Cracking Down on the Courts<\/h2>\n<p>Another arm of the government\u2019s drive to round up undocumented immigrants has been a campaign to change what happens in the courts via new rules or sweeping staff changes.<\/p>\n<p>Since January, EOIR has shaken up the ranks of immigration court judges b<a href=\"https:\/\/www.nbcnews.com\/politics\/immigration\/trump-fired-four-top-immigration-court-officials-hours-taking-office-rcna188637\">y firing the agency\u2019s four top officials<\/a>, who oversee the nation\u2019s immigration court system. Soon after, the agency <a href=\"https:\/\/news.wttw.com\/2025\/07\/15\/trump-administration-fires-17-immigration-court-judges-across-10-states-including\">fired dozens of judges,<\/a> of whom <a href=\"https:\/\/democracyforward.org\/wp-content\/uploads\/2025\/04\/Redacted-2025-04-09-Immigration-Judges-Amended-Appeal.pdf\">13 were in training<\/a> and ready to be assigned.<\/p>\n<p>The judges have since filed a lawsuit against the <a href=\"https:\/\/democracyforward.org\/wp-content\/uploads\/2025\/04\/Redacted-2025-04-09-Immigration-Judges-Amended-Appeal.pdf\">government for failing to give prior notice<\/a>. According to reports, the Department of Justice recently <a href=\"https:\/\/abc7chicago.com\/post\/us-immigration-news-donald-trumps-department-justice-fires-chicago-assistant-chief-judge-jennifer-peyton\/17138067\/\">fired 17 judges, including three from Chicago<\/a>. In addition, dozens more judges have resigned or taken early retirement, according to AILA and <a href=\"https:\/\/www.npr.org\/2025\/04\/08\/nx-s1-5335523\/trump-immigration-judges\">reports.<\/a><\/p>\n<p>Former judges and legal experts immediately reacted to the staff cutbacks by pointing out the irony of staff trimming when the court backlog was expected to grow.<\/p>\n<p>&#8220;It&#8217;s outrageous and against the public interest that at a time when\u2026Congress has authorized 800 immigration judges, we are firing large numbers of immigration judges without cause,&#8221; Matt Biggs, president of the International Federation of Professional and Technical Engineers (IFPTE), a union representing immigration judges, t<a href=\"https:\/\/www.npr.org\/2025\/07\/14\/nx-s1-5467343\/immigration-judges-doj-trump-enforcement\">old<\/a> NPR.<\/p>\n<p>&#8220;This is hypocritical \u2014 you can&#8217;t enforce immigration laws when you fire the enforcers.&#8221;<\/p>\n<p>The acting director of EOIR explained the agency\u2019s new thinking in <a href=\"https:\/\/www.justice.gov\/eoir\/media\/1386541\/dl?inline\">a lengthy memo<\/a>, arguing it aimed to \u201crecommit to its core value and the rule of law.\u201d<\/p>\n<p>Last month, U.S. Senators Elizabeth Warren (D-MA) and Edward Markey (D-MA) wrote to <a href=\"https:\/\/www.warren.senate.gov\/imo\/media\/doc\/letter_from_senators_warren_markey_to_the_department_of_justice_on_non-conversion_of_immigration_judges.pdf\">EOIR<\/a>, challenging the firings of some of the judges in training, saying the government appeared intent on politicizing the court. The judge liked the idea of carrying out justice for the immigrants on their caseload.<\/p>\n<p>But the judge&#8217;s dismay grew daily.<\/p>\n<p>\u201cIt was the general meanness of the system,\u201d the judge said.<\/p>\n<p>At the same time, the judge felt that their job was at risk because the government had <a href=\"https:\/\/www.axios.com\/2025\/03\/07\/immigration-court-staff-retire-resign-backlog\">indicated<\/a> that it would end a <a href=\"https:\/\/www.justice.gov\/eoir\/media\/1390441\/dl?inline\">layer<\/a> of job <a href=\"https:\/\/www.axios.com\/2025\/03\/07\/immigration-court-staff-retire-resign-backlog\">protection<\/a>, suddenly turning judges into at-will employees. Not taking the government\u2019s tough line on immigrants in every case put his job in danger, the judge said.<\/p>\n<p>\u201cThere is a concern that if you don\u2019t make a decision in the way the wind is blowing, a way that would please the administration, that your job would not be safe,\u201d the judge explained.<\/p>\n<p>Earlier this year, Chad Mizelle, the chief of staff of the <a href=\"https:\/\/www.justice.gov\/opa\/pr\/statement-justice-department-chief-staff-chad-mizelle\">Department of Justice,<\/a> claimed immigration court judges \u201cexercised immense power for far too long.\u201d Mizelle noted that the Department was restoring \u201cconstitutional accountability so that Executive Branch officials answer to the President and to the people.\u201d<\/p>\n<p>AILA issued a stern <a href=\"https:\/\/www.aila.org\/library\/policy-brief-the-trump-administration-s-assault-on-immigration-courts\">condemnation<\/a> in response to the onslaught of changes, arguing that the new policies would \u201ctransform judges and the entire court system into arms of the enforcement system rather than neutral, balanced instruments of justice.\u201d<\/p>\n<p>In June, AILA sent out a <a href=\"https:\/\/www.aila.org\/library\/practice-alert-eoir-guidance-to-immigration-judges-on-dismissals-and-other-adjudications\">report<\/a> containing an EOIR email to judges, describing steps they should take \u201cto meet the demands of the increased workload.\u201d In one of them, EOIR ordered judges to make oral decisions immediately after hearing testimony and lawyers\u2019 arguments.<\/p>\n<p>The AILA argued that the EOIR directive \u201cappears to violate the regulations\u201d and urged lawyers to heed its points in their arguments and enter them into the courtroom record.<\/p>\n<p>Similarly, the New York <a href=\"https:\/\/www.nycbar.org\/wp-content\/uploads\/2025\/03\/20221419-TrumpAdminChangesImmigrationLaw.pdf\">City Bar<\/a> recently called the Trump administration\u2019s actions\u00a0 \u201ca radical dismantling of the U.S. immigration system.\u201d The organization urged lawyers in New York and nationwide \u201cto do what they can\u2026to uphold and secure individual rights.\u201d<\/p>\n<p>Whether or not they were responding to the government\u2019s pressures, the nation\u2019s immigration courts have become tougher places for immigrants to win their cases.<\/p>\n<p>The rate of judges\u2019 denials in asylum cases hit 79%<a href=\"https:\/\/datawrapper.dwcdn.net\/X3ZGl\/3\/?utm_source=substack&amp;utm_medium=email\"> nationally<\/a> in April, up from 51 % at the same time last year and the <a href=\"https:\/\/datawrapper.dwcdn.net\/X3ZGl\/3\/?utm_source=substack&amp;utm_medium=email\">highest in 25 years<\/a>.<\/p>\n<p>The latest figures show that Chicago\u2019s Immigration Court judges granted asylum to just over <a href=\"https:\/\/tracreports.org\/phptools\/immigration\/asylum\/\">50%<\/a> of the cases before them as of May.<\/p>\n<p>Amid the steady flow of new courtroom rules \u2014 and after weeks of debating what to do \u2014\u00a0 the veteran immigration court judge quit. The judge wanted to bow out quietly, only announcing their departure to fellow judges and court staff.<\/p>\n<p>\u201cIt really became very obvious to me that, as much as I loved my job. It was no longer a good fit for me as a person,\u201d the judge said.<\/p>\n<p>Then added in a lowered voice, \u201cI miss it.\u201d<\/p>\n<h2 id=\"fear-and-uncertainty\">Fear and Uncertainty<\/h2>\n<p>Almost as soon as Trump announced plans to round up thousands of undocumented immigrants daily, attorneys say fears began spreading.<\/p>\n<p>\u201cThis was such an onslaught of change from the administration,\u201d attorney Shepherd said. These changes have brought on \u201cwidespread fear and panic.\u201d<\/p>\n<p>Some calls she received surprised her. They were from people with legal status, who had no reason to be afraid. \u201cAnd I\u2019ve never seen that before,\u201d she said.<\/p>\n<p>This wasn\u2019t a unique experience.<\/p>\n<p>\u201cEveryone seems to be afraid of being detained, and there\u2019s good reason for them to fear that,\u201d says Martin Perez,\u00a0 attorney with an office in Chicago\u2019s Brighton Park. Seeing what is taking place in immigrant court, Perez has decided to be especially cautious about predicting what may happen in court for his clients.<\/p>\n<p>As an example of the changes, he points to one of his clients, who has lived in the U.S. for 30 years, has four children, and is facing a bond hearing to get out of detention. \u201cIn years past, somebody like that would have been released,\u201d said Perez.<\/p>\n<p>While the administration says its goal is to rid the U.S. of immigrants with criminal records, Perez\u2019s client fits the more common profile of those in detention. About 71% of those held in ICE\u2019s detention facilities in June had no criminal convictions, according to the <a href=\"https:\/\/tracreports.org\/immigration\/detentionstats\/pop_agen_table.html\">TRAC <\/a>system at Syracuse University.<\/p>\n<p>Like many immigration attorneys, Perez said he meets \u201ca lot of people who can\u2019t afford a lawyer\u201d or find a free one. He explained that the problem is compounded by the demand for free services and immigrants\u2019 uncertainty about whom to trust.<\/p>\n<p>Figures show that only one out of <a href=\"https:\/\/tracreports.org\/phptools\/immigration\/backlog\/\">four immigrants in Chicago\u2019s immigration court<\/a> in 2025 had a lawyer, compared to just over one out of three nationally.<\/p>\n<p>Claire Doutre, who was a lawyer in immigration court in Houston before moving to Chicago, recited the changes in court she has witnessed lately.<\/p>\n<p>Prosecutors rarely bargain. Many more clients are detained. And when immigrants are detained, they are sometimes shifted from prison to prison outside of Illinois. Some immigrants are also sent to Texas or Louisiana, facing tougher judges. When they are sent far away, it is hard for Doutre to see them and to discuss their cases. She has to rely on phone or video calls, which makes her worry if everything they say is confidential.<\/p>\n<p>\u201cOn top of not providing attorneys, the system is not friendly at all,\u201d Doutre said. \u201cWhen you enter the court, not everyone will speak your language. You are supposed to know everything.\u201d<\/p>\n<p>\u201cI understand that everyone is just a wheel in the system, and it is hard for people to access the due process they should have.\u201d<\/p>\n<h2 id=\"lost-and-alone\">Lost and Alone<\/h2>\n<p>Inside Chicago\u2019s immigration court for a 10:30 a.m. hearing, Tania recently sat alone waiting for her turn.<\/p>\n<p>The young woman from Ecuador speaks limited English and <a href=\"https:\/\/www.omniglot.com\/writing\/kichwa.htm\">Kichwa,<\/a> a derivative of <a href=\"https:\/\/www.youtube.com\/watch?v=LzbJViFwshU\">Quechua<\/a><b>, <\/b>the language spoken by Indigenous people across the Andes.<\/p>\n<p>She sat all morning in the waiting area outside the courtroom and waited until late afternoon, when nearly all the judges and staff had gone. She sat alone and frightened.<\/p>\n<p>Finally, she turned to a young man from Rogers Park. He had come to court to see how the court process worked because he wanted to get involved in helping immigrants in his neighborhood. He didn\u2019t speak Spanish but quickly found someone who did.<\/p>\n<p>That led her to enter a silent courtroom nearby\u2014not the one she was supposed to attend\u2014where a judge was still on hand. The judge checked Tania\u2019s record and then informed her that her removal from the U.S. had been ordered in the court where she was supposed to appear in the morning.<\/p>\n<p>She looked confused.<\/p>\n<p>From there, she was led to a clerk\u2019s office, where a clerk said that such mishaps sometimes occur and that Tania had to fill out a form for a new trial. Tania stared at the several-page form, written in Spanish, and wondered what to do.<\/p>\n<p>Just then, an attorney from the Help Desk provided by the National Immigrant Justice Center (NIJC) had stepped into a line outside the clerk\u2019s office with some immigrants he was assisting. Hearing about Tania\u2019s dilemma, he promised to help her once he finished his current case. He added that he had helped others with similar problems before.<\/p>\n<p>The woman from Ecuador waited outside his office as a hush fell over the usually busy courtroom area. As she waited, she clutched the form in one hand: her face frozen in the look that she had all day, the look of someone lost in a rapidly spinning wheel.<\/p>\n<p><i>Stephen Franklin is a contributing
