The Supreme Court&#8217;s decision means that Trump&#8217;s decision is canceled and that the program may continue to exist.\u00a0<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">If the court had sided with Trump, Immigration and Customs Enforcement (ICE) <\/span><span style=\"color: #993300;\"><a style=\"color: #993300;\" href=\"https:\/\/www.pbs.org\/newshour\/nation\/immigrants-anxious-as-they-await-supreme-court-daca-decision\"><span style=\"font-weight: 400;\">could<\/span><\/a><\/span><span style=\"font-weight: 400;\"> have begun deporting DACA recipients with final orders of removal.\u00a0\u00a0<\/span><\/span><\/p>\n<p><span style=\"font-weight: 400; color: #000000;\">Here\u2019s what you need to know about DACA ahead of the Supreme Court\u2019s decision.\u00a0<\/span><\/p>\n<h2 id=\"what-is-daca\"><span style=\"color: #000000;\"><b>What is DACA?\u00a0<\/b><\/span><\/h2>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">President Barack Obama created the Deferred Action for Childhood Arrivals program, or DACA, through a presidential memorandum he signed <\/span><span style=\"color: #993300;\"><a style=\"color: #993300;\" href=\"https:\/\/obamawhitehouse.archives.gov\/the-press-office\/2012\/06\/15\/remarks-president-immigration\"><span style=\"font-weight: 400;\">June 15, 2012<\/span><\/a><\/span><span style=\"font-weight: 400;\"><span style=\"color: #993300;\">.<\/span> Obama\u2019s goal was to give qualifying undocumented immigrants brought to the United States as children a reprieve from deportation for a two-year period that was renewable.\u00a0<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"color: #993300;\"><a style=\"color: #993300;\" href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/USCIS\/Resources\/Reports%20and%20Studies\/Immigration%20Forms%20Data\/All%20Form%20Types\/DACA\/DACA_performancedata_fy2020_qtr1.pdf\"><span style=\"font-weight: 400;\">Over 825,000<\/span><\/a><\/span><span style=\"font-weight: 400;\"> eligible immigrants have received DACA status since the policy\u2019s creation. DACA recipients are eligible for a work permit, can freely attend school and apply for a driver\u2019s license. DACA is separate from the<\/span><span style=\"color: #993300;\"><a style=\"color: #993300;\" href=\"https:\/\/www.politico.com\/story\/2010\/12\/dream-act-dies-in-senate-046573\"><span style=\"font-weight: 400;\"> DREAM Act<\/span><\/a><\/span><span style=\"font-weight: 400;\"> that was introduced to Congress by Sen. Dick Durbin (D-Ill.) and former Sen. Orrin Hatch (R-UT) in 2001 but failed to be signed into law. DACA does not provide a path to citizenship and its recipients are <\/span><span style=\"color: #993300;\"><a style=\"color: #993300;\" href=\"https:\/\/studentaid.gov\/sites\/default\/files\/financial-aid-and-undocumented-students.pdf\"><span style=\"font-weight: 400;\">ineligible<\/span><\/a><\/span><span style=\"font-weight: 400;\"> for federal aid or student loans.<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">President Obama attempted to create a similar program for undocumented parents of U.S. citizens and lawful residents in 2014 but that program was also <\/span><span style=\"font-weight: 400;\">blocked<\/span><span style=\"font-weight: 400;\">.\u00a0<\/span><\/span><\/p>\n<h2 id=\"who-are-daca-recipients\"><span style=\"color: #000000;\"><b>Who are DACA recipients?<\/b><\/span><\/h2>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">DACA applicants must meet a number of <\/span><a style=\"color: #000000;\" href=\"https:\/\/www.uscis.gov\/archive\/frequently-asked-questions\"><span style=\"font-weight: 400;\">criteria<\/span><\/a><span style=\"font-weight: 400;\"> in order to qualify for the program, including having lived in the United States continuously since 2007, been under the age of 31 as of June 15, 2012, and having not been convicted of a felony or serious misdemeanor. The application process is complex, involves extensive background checks, and can cost at leas<span style=\"color: #993300;\">t <\/span><\/span><span style=\"color: #993300;\"><a style=\"color: #993300;\" href=\"https:\/\/www.marketplace.org\/2017\/10\/13\/cost-being-daca-recipient\/\"><span style=\"font-weight: 400;\">$495.<\/span><\/a><\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">The oldest DACA recipients are now in their late 30s and many have established lives and careers in the United States. DACA recipients have an estimated <\/span><span style=\"color: #993300;\"><a style=\"color: #993300;\" href=\"https:\/\/www.americanprogress.org\/issues\/immigration\/news\/2020\/04\/06\/482676\/know-demographic-economic-impacts-daca-recipients-spring-2020-edition\/\"><span style=\"font-weight: 400;\">250,000 U.S.-born children<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">More than 80% of DACA recipients were born in Mexico. California and Texas have the highest number of DACA recipients The Chicago metropolitan area is home to over <\/span><span style=\"color: #993300;\"><a style=\"color: #993300;\" href=\"https:\/\/www.pewresearch.org\/fact-tank\/2017\/09\/25\/key-facts-about-unauthorized-immigrants-enrolled-in-daca\/\"><span style=\"font-weight: 400;\">34,000 DACA<\/span><\/a><\/span><span style=\"font-weight: 400;\"> recipients.\u00a0\u00a0\u00a0\u00a0<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">DACA recipients <\/span><span style=\"color: #993300;\"><a style=\"color: #993300;\" href=\"https:\/\/www.americanprogress.org\/issues\/immigration\/news\/2020\/04\/06\/482708\/demographic-profile-daca-recipients-frontlines-coronavirus-response\/\"><span style=\"font-weight: 400;\">work and study in a variety of fields<\/span><\/a><\/span><span style=\"font-weight: 400;\"><span style=\"color: #993300;\">.<\/span> An estimated 29,000 DACA recipients are health care workers and advocates worry that if those recipients lose their status it could jeopardize the United States\u2019 fight against coronavirus.<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">Each year, DACA recipients and those in their household <\/span><a style=\"color: #000000;\" href=\"https:\/\/www.americanprogress.org\/issues\/immigration\/news\/2020\/04\/06\/482676\/know-demographic-economic-impacts-daca-recipients-spring-2020-edition\/\"><span style=\"font-weight: 400;\">pay<\/span><\/a><span style=\"font-weight: 400;\"> $5.6 billion in federal taxes and $3.1 billion in state and local taxes.\u00a0<\/span><\/span><\/p>\n<h2 id=\"why-is-the-supreme-court-weighing-in-on-daca\"><span style=\"color: #000000;\"><b>Why is the Supreme Court Weighing in on DACA?\u00a0<\/b><\/span><\/h2>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">Former Attorney General <\/span><span style=\"color: #993300;\"><a style=\"color: #993300;\" href=\"https:\/\/www.justice.gov\/ag\/bio\/attorney-general-jeff-sessions\"><span style=\"font-weight: 400;\">Jeff Sessions<\/span><\/a><\/span><span style=\"font-weight: 400;\"> announced Trump\u2019s plan to rescind DACA on <\/span><a style=\"color: #000000;\" href=\"https:\/\/www.politico.com\/story\/2017\/09\/05\/trump-ending-daca-dreamers-program-sessions-transcript-242326\"><span style=\"font-weight: 400;\">Sept. 5, 2017<\/span><\/a><span style=\"font-weight: 400;\">. Over<\/span><span style=\"color: #993300;\"><a style=\"color: #993300;\" href=\"https:\/\/www.nilc.org\/issues\/daca\/litigation-related-to-the-daca-program\/\"><span style=\"font-weight: 400;\"> ten legal challenges to Trump\u2019s decision<\/span><\/a><\/span><span style=\"font-weight: 400;\"> were filed arguing that his administration had violated equal protection and due process rights.\u00a0<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">On June 28, 2019, the Supreme Court <\/span><span style=\"color: #993300;\"><a style=\"color: #993300;\" href=\"https:\/\/www.nilc.org\/issues\/daca\/daca-litigation-timeline\/\"><span style=\"font-weight: 400;\">agreed<\/span><\/a><\/span><span style=\"font-weight: 400;\"> to hear three of the complaints challenging Trump\u2019s decision to end DACA. The court will first decide if it can review the Trump administration\u2019s decision. If the court decides it can, then it will review if Trump\u2019s decision to terminate DACA was legal.\u00a0<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">The Supreme Court heard <\/span><span style=\"color: #993300;\"><a style=\"color: #993300;\" href=\"https:\/\/www.cnn.com\/2019\/11\/12\/politics\/daca-supreme-court-arguments\/index.html\"><span style=\"font-weight: 400;\">oral arguments<\/span><\/a><\/span><span style=\"font-weight: 400;\"><span style=\"color: #993300;\">\u00a0<\/span> Nov. 12, 2019. The court later agreed to allow DACA advocates to <\/span><span style=\"color: #993300;\"><a style=\"color: #993300;\" href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2020\/04\/20\/daca-supreme-court-agrees-new-filing-recipients-pandemic-work\/5164391002\/\"><span style=\"font-weight: 400;\">make an additional filing<\/span><\/a><\/span><span style=\"font-weight: 400;\"> on April 20, 2020 arguing DACA recipients provide essential health care during the coronavirus pandemic.<\/span><\/span><\/p>\n<p><span style=\"font-weight: 400; color: #000000;\">Their decision on these cases was announced June 18, 2020.<\/span><\/p>\n<h2 id=\"what-did-the-court-decide\"><span style=\"color: #000000;\"><b>What did the court decide?<\/b><\/span><\/h2>\n<p><span style=\"font-weight: 400; color: #000000;\">The Supreme Court <\/span><span style=\"font-weight: 400; color: #000000;\">decided it does have the authority to review the matter and that <a href=\"https:\/\/www.supremecourt.gov\/opinions\/19pdf\/18-587_5ifl.pdf\">Trump&#8217;s termination of DACA was unlawful.<\/a> <\/span><\/p>\n<p>In the court&#8217;s opinion, Chief Justice Roberts wrote, &#8220;We conclude that the Acting Secretary did violate the [Administrative Procedure Act], and that the rescission must be vacated.&#8221; The decision will allow DACA to continue as a program, but the president may attempt to end the program again in the future.<\/p>\n<h2 id=\"how-can-i-apply-for-daca\"><span style=\"color: #000000;\"><b>How can I apply for DACA?\u00a0<\/b><\/span><\/h2>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">The U.S. Citizenship and Immigration Services is<\/span><span style=\"color: #993300;\"><a style=\"color: #993300;\" href=\"https:\/\/www.uscis.gov\/archive\/renew-your-daca\"><span style=\"font-weight: 400;\"> accepting applications for DACA renewal<\/span><\/a><\/span><span style=\"font-weight: 400;\"> at this time but not any new applications.
