For the first time, the IRS will allow immigration authorities to request access to individual taxpayer data to aid its deportation operations.<\/p>\n<p>It\u2019s President Donald Trump\u2019s latest effort to use federal agencies traditionally not involved with immigration proceedings in his administration\u2019s goal of mass deportations.<\/p>\n<p>The Department of Homeland Security\u2019s memorandum of understanding to work with the IRS contributed to the <a href=\"https:\/\/www.reuters.com\/world\/us\/us-irs-chief-quit-over-deal-share-data-with-immigration-officials-report-says-2025-04-08\/\">resignation of top IRS officials<\/a>, including the agency\u2019s commissioner. The commissioner\u2019s resignation was the third this year, as one previous commissioner <a href=\"https:\/\/www.cnn.com\/2025\/04\/08\/politics\/melanie-krause-acting-irs-commissioner-resigning\/index.html\">resigned on Inauguration Day<\/a> and another retired after refusing to sign the data-sharing agreement with DHS, which oversees Immigration and Customs Enforcement.<\/p>\n<\/div>\n\n\n\n<div class=\"templatera_shortcode\">\n\t\t<div id=\"fws_69ee3b545c9ef\"  data-column-margin=\"default\" data-midnight=\"dark\"  class=\"wpb_row vc_row-fluid vc_row vc_row-o-equal-height vc_row-flex vc_row-o-content-middle small\"  style=\"padding-top: 0px; \" class=\"vc_col-sm-5 wpb_column column_container vc_column_container col child_column neg-marg no-extra-padding inherit_tablet inherit_phone \"   data-padding-pos=\"all\" data-has-bg-color=\"false\" data-bg-color=\"\" data-bg-opacity=\"1\" data-animation=\"\" data-delay=\"0\" >\n\t\t<div class=\"vc_column-inner\" >\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t\n\t<div class=\"wpb_raw_code wpb_raw_html wpb_content_element\" >\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<div class=\"_form_1\"><\/div><script src=\"https:\/\/borderlessmag.bluelena.io\/f\/embed.php?id=1\" charset=\"utf-8\"><\/script>\n\t\t<\/div>\n\t<\/div>\n\n\t\t<\/div> \n\t<\/div>\n\t<\/div> \n<\/div><\/div>\n\t\t\t<\/div> \n\t\t<\/div>\n\t<\/div> \n<\/div><\/div>\n\n\t\t\t<\/div> \n\t\t<\/div>\n\t<\/div> \n<\/div><\/div><\/div>\n<div class=\"wpb_text_column wpb_content_element \" >\n\t<p>Immigrant rights advocates say the agreement <a href=\"https:\/\/www.ilrc.org\/immigrant-legal-resource-center-denounces-irs-agreement-cooperate-ice-sharing-sensitive-data\">violates taxpayer privacy<\/a> and will push undocumented taxpayers deeper into the shadows.<\/p>\n<p>\u201c[This] has certainly never been done before,\u201d said Bradley Jenkins, managing attorney at the Amica Center for Immigrant Rights. \u201cI do fear it is going to sweep up a lot of people who are trying to play it right.\u201d<br \/>\nBorderless Magazine compiled a guide about this new deal, its potential impact, and what to know this Tax Day.<\/p>\n<h2 id=\"whats-the-new-deal-with-ice-and-the-irs\">What\u2019s the new deal with ICE and the IRS?<\/h2>\n<p>According to <a href=\"https:\/\/www.courtlistener.com\/docket\/69714586\/30\/1\/centro-de-trabajadores-unidos-v-bessent\/\">court documents<\/a>, ICE and the IRS have signed a memorandum of understanding (MOU) referencing a part of the IRS\u2019 code that allows the agency to share information about individuals \u201cunder criminal investigation.\u201d Typically, the IRS is restricted from sharing information about individuals and their tax returns.<\/p>\n<p>An MOU <a href=\"https:\/\/hcsra.sph.harvard.edu\/memorandum-understanding-mou\">isn\u2019t legally binding<\/a> but sets expectations for how different groups should work together.<\/p>\n<p>In this new deal, DHS can request information from the IRS <a href=\"https:\/\/www.alianzaamericas.org\/tool\/what-we-know-about-the-irs-and-dhs-collaboration-plan\">about specific individuals<\/a>, such as their home address, phone number or other identifying information.<\/p>\n<p>The new agreement does not mean that DHS has blanket access to all of the IRS\u2019 data.<\/p>\n<h2 id=\"whos-impacted-by-these-changes\">Who\u2019s impacted by these changes?<\/h2>\n<p>Immigrants who do not have legal status and are already at risk of deportation will likely be targeted by this policy change. The IRS has issued almost <a href=\"https:\/\/www.tigta.gov\/sites\/default\/files\/reports\/2023-12\/2024400012fr.pdf\">26 million ITINs<\/a> since the program began in 1996, according to the Treasury Inspector General for Tax Administration.<\/p>\n<h2 id=\"should-i-still-file-my-taxes-this-year\">Should I still file my taxes this year?<\/h2>\n<p><a href=\"https:\/\/www.alianzaamericas.org\/tool\/what-we-know-about-the-irs-and-dhs-collaboration-plan\">Under federal law<\/a>, anyone who earns money in the United States is required to file a tax return. Choosing not to do so could result in criminal charges.<\/p>\n<p>If you have an ITIN or previously paid taxes, the IRS already has records of your tax filings that contain your personal information. According to court documents, as of April 7, the IRS has not yet provided any taxpayer information to DHS. However, your pre-existing information may be subject to the new agreement.<\/p>\n<p>If you are in the U.S. without legal status, it is best to consult with a lawyer familiar with your immigration case to understand the risks and benefits of filing your taxes this year.<\/p>\n<h2 id=\"what-are-immigrant-rights-advocates-saying\">What are immigrant rights advocates saying?<\/h2>\n<p>Several congressional Democrats, including Rep. Delia C. Ramirez of Illinois\u2019 3rd District, wrote a letter to DHS and IRS last month urging the federal agencies not to proceed with the agreement.<\/p>\n<p>\u201cIf immigrants fear that filing taxes could expose them to deportation, many will choose not to file,\u201d they <a href=\"https:\/\/wassermanschultz.house.gov\/uploadedfiles\/final_irs-dhs_letter.pdf\">wrote<\/a>. \u201cThis would increase deficits and shift a higher proportion of the tax burden onto American citizens.\u201d<\/p>\n<p>Similarly, the CEO of the New York Immigration Coalition, Murad Awaedeh, condemned the IRS\u2019 decision, stating it threatened the safety of thousands of taxpayers.<\/p>\n<p>\u201cInstead of punishing people who contribute and comply with our tax laws, our government should be working to protect their rights and build trust,\u201d Awaedeh said.<\/p>\n<p><i>This story is for information purposes only.
