The arrests violate immigration laws and a prior settlement agreement that restricted ICE from making warrantless arrests, the attorneys said.<\/p>\n<p>In six cases, ICE agents arrested people after stopping their cars or while they were in their cars, and ICE agents forced their way into the detainees\u2019 homes three other times, <a href=\"https:\/\/immigrantjustice.org\/sites\/default\/files\/uploaded-files\/no-content-type\/2025-03\/164-Nava-v-DHS_Motion-to-Enforce-the-Settlement_03-13-25.pdf?eType=EmailBlastContent&amp;eId=c43640f5-51ba-4e85-ba4d-ab6f4307cbc9\" target=\"_blank\" rel=\"external noopener noreferrer\" data-wpel-link=\"external\">according to the lawsuit.<\/a><\/p>\n<\/div>\n\n\n\n<div class=\"templatera_shortcode\">\n\t\t<div id=\"fws_69dea6ba1a7c3\"  data-column-margin=\"default\" data-midnight=\"dark\"  class=\"wpb_row vc_row-fluid vc_row vc_row-o-equal-height vc_row-flex vc_row-o-content-middle small\"  style=\"padding-top: 0px; They want those who have been arrested and released to have their bond payments reimbursed and have any release conditions lifted.<\/p>\n<p>The groups are also asking authorities to identify ICE agents who violated the 2022 settlement and to participate in \u201cremedial efforts\u201d that could include termination, probation, fines and\/or retraining. In one case, the new filing is seeking a stay of the planned removal of one person arrested by ICE agents this year and an order requiring the government to return a person previously deported from the United States.<\/p>\n<p>It also asks the court to demand immigration authorities release a report of all immigration arrests since Jan. 20 by the ICE Chicago field office, which oversees operations in Illinois, Indiana, Wisconsin, Missouri, Kentucky and Kansas.<\/p>\n<p>Rebecca Glenberg, senior staff attorney for the ACLU of Illinois, said ICE officers this year have made arrests without warrants, failed to document warrantless arrests, obtained a warrant after making a warrantless arrest and arrested people without probable cause and without evaluating their flight risk.<\/p>\n<p>In several of these cases, ICE officers made \u201ccollateral arrests\u201d or arrested individuals after making a traffic stop.<\/p>\n<p>Abel Orozco Ortega, a 40-year-old man from suburban Lyons, was arrested Jan. 26 by ICE after immigration authorities stopped him as he returned from buying food for his family. After his detention, Orozco Ortega was taken to Indiana, where he remains in the custody of immigration authorities.<\/p>\n<p>Orozco Ortega had no criminal record and was the sole provider for his family, said his wife, Yolanda Orozco. She was diagnosed with breast cancer and is unsure how she will pay for medical care and housing while her husband is detained, she said.<\/p>\n<p>\u201cHe is a working man. He is loving. He is caring. He\u2019s responsible. He is somebody to look up to, and he is an honest man, and he shouldn\u2019t have been arrested,\u201d said his son, Eduardo Ortega.<\/p>\n<aside class=\"scaip scaip-2 \">\n<div class=\"newspack_global_ad scaip-2 fixed-height\">\n<div id=\"div-gpt-ad-73f736f887-0\" data-google-query-id=\"CK3yvoDDlowDFcrcGAIdzSkxZg\">\n<div id=\"google_ads_iframe_\/22997378029\/newspack-in-article-2-6511c2970b70d_1__container__\">In another case, ICE arrested a U.S. citizen without a warrant, and immigration officers did not document the warrantless arrest, which is required by law, Fleming said.<\/div>\n<div><\/div>\n<div>Julio Noriega, a 54-year-old man born in Chicago, was arrested Jan. 31 in suburban Berwyn while handing out his resume to businesses near Harlem Avenue and Cermak Road. About 10 hours later, he was released without paperwork and money after ICE officers discovered he had identification proving his U.S. citizenship. Noriega said he was never shown a warrant or asked questions to determine if he was a citizen or a flight risk, according to the lawsuit.<\/p>\n<p>The new filing also describes the ICE arrests of 12 people without a warrant Feb. 7 at a Mexican restaurant in Liberty, Missouri. After the arrest, ICE created documents for their deportation but did not specify the reasons to arrest them without a warrant. The case is under the jurisdiction of ICE\u2019s Chicago office, attorneys said.<\/p>\n<p>Nine people were detained and released under bond, one person is still detained and another was already deported, according to the lawsuit.<\/p>\n<p>In five cases included in the lawsuit, even if the arrests started as investigatory stops, \u201cthey quickly became warrantless arrests,\u201d according to the lawsuit.<\/p>\n<p>ICE officers can stop cars when there is \u201creasonable suspicion\u201d a specific immigrant whom they know or believe is illegally in the United States is in the car. In these cases, ICE officers arrested the individuals named in the lawsuit before having a warrant, according to the lawsuit.<\/p>\n<p>Fleming said the new class action motion is also asking ICE to provide weekly reports of federal immigration arrests in the Chicago area of responsibility. Despite repeated requests from reporters, <a href=\"https:\/\/blockclubchicago.org\/2025\/03\/04\/ice-says-it-will-reveal-who-was-arrested-in-chicago-as-soon-as-possible-which-might-be-never\/\" data-wpel-link=\"internal\">ICE officials haven\u2019t disclosed exactly who their agents arrested in <\/a>Chicago, what they were arrested for or what\u2019s happened to them since.<\/p>\n<p>\u201cWe\u2019re asking for the court to order a list and the underlying documents of everyone that was arrested in a non-custodial environment since the inauguration,\u201d Fleming said.<\/p>\n<p>These violations are \u201cpart of a larger effort to execute the administration\u2019s threats of mass deportation,\u201d said Fred Tsao, senior policy counsel for the Illinois Coalition for Immigrant and Refugee Rights.
