Borderless Magazine does not provide legal assistance or legal advice.<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">With President-elect Donald Trump taking office, organizations nationwide have been preparing for his hardline immigration promises with Know Your Rights workshops.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Immigration advocates hope to equip immigrants with critical information about their rights in light of Trump\u2019s plans to carry out mass deportations and <\/span><a href=\"https:\/\/time.com\/7022828\/trump-travel-ban-refugees-gaza\/\"><span style=\"font-weight: 400;\">reinstate travel bans<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWhen people are interacting with immigration agents, if they do so in the wrong way, they can get themselves in trouble \u2014\u00a0they can get arrested, they can say stuff that can set themselves up for deportation,\u201d said Fred Tsao, senior policy counsel at the Illinois Coalition for Immigrant and Refugee Rights. \u201cWe want to make sure that people know what their rights are and feel comfortable being able to exercise them.\u201d<\/span><\/p>\n<\/div>\n\n\n\n<div class=\"templatera_shortcode\">\n\t\t<div id=\"fws_69df0412ebfc7\"  data-column-margin=\"default\" data-midnight=\"dark\"  class=\"wpb_row vc_row-fluid vc_row vc_row-o-equal-height vc_row-flex vc_row-o-content-middle small\"  style=\"padding-top: 0px; It\u2019s not even just people who are legally here. It\u2019s everybody.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Trump\u2019s Border Czar, Tom Homan, said the administration plans on<\/span><a href=\"https:\/\/thehill.com\/homenews\/administration\/5056299-tom-homan-border-czar\/\"> <span style=\"font-weight: 400;\">reviving family detention centers<\/span><\/a><span style=\"font-weight: 400;\"> and<\/span><a href=\"https:\/\/thehill.com\/homenews\/administration\/5056599-trump-border-czar-tom-homan-family-detention-centers-immigration\/\"> <span style=\"font-weight: 400;\">instating halfway homes for children of noncitizens<\/span><\/a><span style=\"font-weight: 400;\">. He also promised last month that the administration\u2019s deportation plans will<\/span><a href=\"https:\/\/www.cbsnews.com\/chicago\/news\/tom-homan-trump-border-czar-chicago\/\"> <span style=\"font-weight: 400;\">begin in Chicago<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Dulce Guzm\u00e1n, executive director of Alianza Americas, emphasized the need for mental health services during this time of uncertainty. While informing immigrants of their rights is important, it can also generate anxiety and fear of what\u2019s to come, she said.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWe\u2019re in a waiting game,\u201d Guzm\u00e1n said. \u201cBut [we\u2019re] making sure that we have the people, the resources, and most importantly that we stay grounded\u2026because this is going to be a long next four years.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Outside of Know Your Rights education, Tsao added that ICIRR encourages people to get involved in their communities \u2014 whether through a local organization, labor union or faith congregation.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cPeople are not alone,\u201d Tsao said. \u201cThere are family members, institutions, organizations that can provide assistance, support and help.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Borderless spoke with local immigrant leaders and immigrant rights organizations to compile this Know Your Rights guide. Read on to learn what rights you are entitled to here in Chicago, regardless of immigration status.<\/span><\/p>\n<h2 id=\"you-have-the-right-to-remain-silent\"><span style=\"font-weight: 400;\">You Have The Right To Remain Silent<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Under the Fifth Amendment of the U.S. Constitution, you do not have to speak with an Immigration and Customs Enforcement (ICE) agent, answer their questions, or sign any papers if they ask, according to the <\/span><a href=\"https:\/\/www.ilrc.org\/red-cards-tarjetas-rojas\"><span style=\"font-weight: 400;\">Immigrant Legal Resource Center<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The right to remain silent includes protections around \u201c<\/span><a href=\"https:\/\/www.law.cornell.edu\/wex\/self-incrimination\"><span style=\"font-weight: 400;\">self-incrimination<\/span><\/a><span style=\"font-weight: 400;\">,\u201d which means saying anything that may signal your responsibility or involvement in a crime. That means you have the right not to speak with an ICE agent. You don\u2019t have to tell them anything about your citizenship status or what country you are from.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Anything you share with an immigration officer or federal official can be used against you in immigration court. If you choose to answer questions, know that lying to an immigration officer has permanent consequences that can bar you from citizenship.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you decides to speak, immigrant rights groups recommend that you ask to talk to a lawyer or request to see an arrest warrant with your name.<\/span><\/p>\n<\/div>\n\n\n\n\n<div class=\"wpb_text_column wpb_content_element \" >\n\t<h2 id=\"you-have-the-right-to-walk-away-from-an-interaction-with-ice\"><span style=\"font-weight: 400;\">You Have The Right To Walk Away From An Interaction With ICE<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">If you are stopped by an officer, you can <\/span><a href=\"https:\/\/www.informedimmigrant.com\/resources\/detention-deportation\/know-your-rights\/#accordion__heading-If-you-are-stopped-in-a-public-space\"><span style=\"font-weight: 400;\">ask whether you are being arrested or detained<\/span><\/a><span style=\"font-weight: 400;\">. If you are not being arrested or detained, you have the right to walk away from an interaction with ICE, according to Informed Immigrant, an immigrant resources organization.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you are arrested by ICE, you can ask to call a lawyer, according to the American Civil Liberties Union (<\/span><a href=\"https:\/\/www.aclu.org\/know-your-rights\/immigrants-rights\"><span style=\"font-weight: 400;\">ACLU<\/span><\/a><span style=\"font-weight: 400;\">). You do not have to sign any documents without your lawyer present.<\/span><\/p>\n<h2 id=\"you-have-the-right-to-refuse-to-be-searched\"><span style=\"font-weight: 400;\">You Have The Right To Refuse To Be Searched<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">You can choose not to consent to being searched by ICE officials by saying: \u201cI do not consent to being searched.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">ICE officials do not have the right to search you without your consent or probable cause, according to the ACLU. Probable cause means that an official must have a \u201c<\/span><a href=\"https:\/\/www.law.cornell.edu\/wex\/probable_cause\"><span style=\"font-weight: 400;\">reasonable<\/span><\/a><span style=\"font-weight: 400;\">\u201d basis for believing you may have committed a crime, according to the Cornell Law School Legal Information Institute.\u00a0<\/span><\/p>\n<\/div>\n\n\n\n\n\t\t\t<\/div> \n\t\t<\/div>\n\t<\/div> \n\n\t<div  class=\"vc_col-sm-2 vc_hidden-sm vc_hidden-xs wpb_column column_container vc_column_container col no-extra-padding inherit_tablet inherit_phone \"  data-padding-pos=\"all\" data-has-bg-color=\"false\" data-bg-color=\"\" data-bg-opacity=\"1\" data-animation=\"\" data-delay=\"0\" >\n\t\t<div style=\"font-weight: 400;\">Under the Fourth Amendment of the U.S. Constitution, you are protected against \u201c<\/span><a href=\"https:\/\/www.uscourts.gov\/about-federal-courts\/educational-resources\/about-educational-outreach\/activity-resources\/what-does-fourth-amendment-mean#:~:text=The%20Constitution%2C%20through%20the%20Fourth,deemed%20unreasonable%20under%20the%20law.\"><span style=\"font-weight: 400;\">unreasonable searches and seizures<\/span><\/a><span style=\"font-weight: 400;\">.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This means ICE officials cannot search you or your home without your consent or a warrant signed by a <\/span><a href=\"https:\/\/immigrantjustice.org\/know-your-rights\/ice-encounter\"><span style=\"font-weight: 400;\">judge<\/span><\/a><span style=\"font-weight: 400;\">. Some ICE officials may present warrants that are not signed by a judge, which do not grant them access to your home <\/span><a href=\"https:\/\/immigrantjustice.org\/know-your-rights\/ice-encounter\"><span style=\"font-weight: 400;\">without your consent<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h2 id=\"you-do-not-have-to-sign-any-documents\"><span style=\"font-weight: 400;\">You Do Not Have To Sign Any Documents<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">You have the right to refuse to sign any documents presented to you by ICE.<\/span><\/p>\n<p><a href=\"https:\/\/unitedwedream.org\/resources\/know-your-rights\/?gad_source=1\"><span style=\"font-weight: 400;\">United We Dream<\/span><\/a><span style=\"font-weight: 400;\">, a youth-led immigrant advocacy group, recommends you decline signing any documents ICE presents to you. Many groups recommend speaking to an immigration lawyer before signing any documents. This is because, in most cases, you have the right to a hearing with a judge to challenge your deportation. If you sign something called a \u201cStipulated Removal Order,\u201d for example, you waive your right to that hearing, according to the <\/span><a href=\"https:\/\/www.aclu.org\/know-your-rights\/immigrants-rights\"><span style=\"font-weight: 400;\">ACLU<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h2 id=\"you-have-the-right-to-hire-a-lawyer\"><span style=\"font-weight: 400;\">You Have The Right To Hire A Lawyer<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Under the <\/span><a href=\"https:\/\/www.americanimmigrationcouncil.org\/research\/access-counsel-immigration-court\"><span style=\"font-weight: 400;\">Sixth Amendment<\/span><\/a><span style=\"font-weight: 400;\">, you have the right to consult with a lawyer for your immigration proceedings.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you are arrested or detained by ICE or Border Patrol, <\/span><a href=\"https:\/\/www.aclu.org\/know-your-rights\/immigrants-rights#i-am-detained-while-my-immigration-case-is-underway\"><span style=\"font-weight: 400;\">you have the right to hire a lawyer<\/span><\/a><span style=\"font-weight: 400;\">, but the government does not have to provide one. If the police arrest you, you have the right to a <\/span><a href=\"https:\/\/www.aclu.org\/know-your-rights\/immigrants-rights#i-am-detained-while-my-immigration-case-is-underway\"><span style=\"font-weight: 400;\">government-appointed lawyer<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">You have the right to have your lawyer with you at any hearing with an immigration judge.<\/span><\/p>\n<h2 id=\"police-officers-are-restricted-from-working-with-ice-in-chicago-and-illinois\"><span style=\"font-weight: 400;\">Police Officers Are Restricted From Working With ICE in Chicago and Illinois\u00a0\u00a0<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Under Chicago\u2019s \u201c<\/span><a href=\"https:\/\/www.chicago.gov\/city\/en\/depts\/mayor\/supp_info\/office-of-new-americans\/welcoming-city-supportive-resources.html#:~:text=As%20such%2C%20the%20welcoming%20City,the%20basis%20of%20immigration%20status.\"><span style=\"font-weight: 400;\">Welcoming City\u201d ordinance<\/span><\/a><span style=\"font-weight: 400;\"> and the <\/span><a href=\"https:\/\/www.aclu-il.org\/en\/cases\/trust-act#:~:text=The%20goal%20of%20the%20TRUST,to%20immigration%20detention%20or%20deportation.\"><span style=\"font-weight: 400;\">Illinois TRUST Act<\/span><\/a><span style=\"font-weight: 400;\">, the Chicago Police Department (CPD) cannot cooperate with ICE officials seeking to deport immigrants and CPD is not allowed to arrest someone based on their immigration status.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Under these policies, the Chicago Police Department is also prohibited from asking an individual about their immigration status or questioning, arresting, or prosecuting someone based on the suspicion of being undocumented.\u00a0<\/span><\/p>\n<h2 id=\"you-have-the-right-to-take-photos-in-public-spaces-if-you-have-an-interaction-with-ice\"><span style=\"font-weight: 400;\">You Have The Right To Take Photos In Public Spaces If You Have An Interaction With ICE\u00a0<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Under the First Amendment, individuals can <\/span><a href=\"https:\/\/www.aclu.org\/issues\/free-speech\/photographers-rights#:~:text=Taking%20photographs%20and%20video%20of,officials%20carrying%20out%20their%20duties.\"><span style=\"font-weight: 400;\">take photos<\/span><\/a><span style=\"font-weight: 400;\"> and record videos in public spaces.\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/unitedwedream.org\/resources\/know-your-rights\/?gad_source=1\"><span style=\"font-weight: 400;\">United We Dream<\/span><\/a><span style=\"font-weight: 400;\"> suggests ensuring photos and videos are synced to iCloud or Google Photos so a trusted relative or friend can access them if you record an interaction with ICE.\u00a0<\/span><\/p>\n<h2 id=\"other-resources\"><span style=\"font-weight: 400;\">Other Resources<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Many organizations in Chicago offer free or low-cost mental health services to immigrants and refugees facing fear or anxiety due to anti-immigrant policies and rhetoric, displacement, violence and more.
